{"data":{"id":"us-ky/krs-175b.025","jurisdiction":"us-ky","citation":"KRS 175B.025","heading":"Powers and duties of developing authority and issuing authority --","body":"Project development restrictions.\n(1) The  developing authority and issuing authority may be the same authority or\nseparate authorities, depending on the needs of the project. The developing\nauthority and issuing authority shall have the following powers and duties, as\nnecessary to complete, operate, and maintain the project, subject to the\nlimitations provided in KRS 175B.020(10):\n(a) To  enter into agreements as necessary to facilitate the development,\nconstruction, maintenance, operation, repair, or financing of projects;\n(b) To  directly or indirectly construct, reconstruct, maintain, repair, operate,\nand regulate projects within the Commonwealth,  or contract with another\nentity for these services;\n(c) To  issue project revenue bonds of the issuing authority payable solely\nfrom  the tolls, revenues, rentals, funds from any grant anticipation\nrevenue vehicle (GARVEE),  funds appropriated by the state or federal\ngovernment, and any other funds pledged for their payment, for the\npurpose of paying all or any cost of a project, and to refund any of its\nbonds;\n(d) 1. To  fix, revise, charge, and collect tolls for transit over any project\nconstructed by it, and for any ancillary or connector routes affected\nby the project.\n2. No  tolls shall be authorized by any developing or issuing authority\nas a part of any development agreement or any financial plan for:\na. Any project involving the federal interstate highway system that\nconnects the Commonwealth  with the State of Ohio; or\nb. Any  project constituting a fully or partially controlled highway,\nwhether or not involving the federal interstate highway system,\nthat connects the Commonwealth  with the State of Ohio,\nincluding but not limited to a qualifying highway that constitutes\na bypass of a major metropolitan area;\n(e) To establish and enforce rules and regulations for the use of a project;\n(f) To acquire and hold any of the following in the name  of the developing\nauthority, and to dispose of them as the developing authority deems\nnecessary:\n1. Real and personal property, including lands and structures;\n2. Rights;\n3. Rights-of-way;\n4. Franchises;\n5. Easements  and other interests in lands, including lands lying under\nwater and riparian rights; and\n6. Any other item or asset necessary to accomplish its mission;\n(g) To  designate the locations and establish, limit, and control points of\naccess to the project, and to prohibit access to the project from any\nundesignated point;\n(h) To make and enter into contracts and agreements in the performance of\nduties and the execution of powers under this chapter;\n(i) To employ any consultants and to fix their compensation;\n(j) To receive and accept contributions and grants from any source for or in\naid of the construction of a project or the operation of the developing or\nissuing authority;\n(k) To accept interest rate subsidies, rebates, tax credits, or guarantees as\nprovided in the American Recovery and Reinvestment Act of 2009, or as\nmay  be provided in subsequent federal legislation providing support to or\ncredit enhancement of governmental obligations;\n(l) To  expend any funds provided under this chapter in advertising the\nfacilities and services of a project to the traveling public;\n(m) To enter into lease agreements with the department; and\n(n) To  do acts necessary or convenient to carry out the powers expressly\ngranted in this chapter.\n(2) Projects may be developed in conjunction with other road development efforts\nof  the Commonwealth  that are in compliance with Federal Highway\nAdministration requirements.\n(3) Projects developed pursuant to this chapter shall:\n(a) Comply  with the requirements of KRS Chapters 45A, 174, and 176;\n(b) Be  included in the most recently enacted biennial highway construction\nplan; and\n(c) Comply  with all relevant requirements of the  Federal Highway\nAdministration.","path":["KRS Chapter 175B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44869","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:26Z","sha256":"9a1cb032333fcbced0f3a6c6ceea1537777d0792902b50cd80c47fc0fc57e856","source_id":"us-ky","stale":false,"prev":"us-ky/krs-175b.020","next":"us-ky/krs-175b.030"},"notice":"GroundRules: Original legal text.
