{"data":{"id":"us-ky/krs-175b.037","jurisdiction":"us-ky","citation":"KRS 175B.037","heading":"Use of public-private partnership -- Requirements -- Administrative","body":"regulations.\n(1) The  state authority, a bi-state authority, or a project authority may, with\napproval of the General Assembly pursuant to KRS  175B.020(10), and if\napplicable, KRS 175B.030(9), utilize a public-private partnership.\n(2) An  authority utilizing a  public-private partnership shall continue to be\nresponsible for oversight of any function authorized by this chapter that is\ndelegated to or otherwise performed by a public-private partnership.\n(3) A public-private partnership shall not be used to circumvent any requirements\nor restrictions placed upon any authority pursuant to this chapter.\n(4) An authority proposing to utilize a public-private partnership shall include in the\nfinancial plan required by KRS 175B.030 or 175B.035:\n(a) The parameters of the public-private partnership agreement;\n(b) The duties and responsibilities to be performed by the private partner or\npartners;\n(c) The methods of oversight to be employed by the authority;\n(d) The duties and responsibilities of the project that are to be performed by\nthe authority, the cabinet, and any other partners to the agreement; and\n(e) Other  information required by the state authority or the cabinet to\nevaluate the financial plan and the proposed public-private partnership.\n(5) A  private entity desiring to be a private partner shall demonstrate to the\nsatisfaction of the state authority and  the cabinet that it is capable of\nperforming any function to be authorized by the public-private partnership.\n(6) A public-private partnership authorized or utilized pursuant to this section shall\nbe subject to KRS 176B.030(5) to (8).\n(7) The  cabinet shall promulgate administrative regulations detailing the\nprocurement  approach and  proposal review process to be  used  for a\npublic-private partnership by December 31, 2016.","path":["KRS Chapter 175B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44865","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:26Z","sha256":"c49aa6d5647ceae4efa4c896694891109eeaf3839418b9fb2788497efad11952","source_id":"us-ky","stale":false,"prev":"us-ky/krs-175b.035","next":"us-ky/krs-175b.040"},"notice":"GroundRules: Original legal text.
