{"data":{"id":"us-ky/krs-176.056","jurisdiction":"us-ky","citation":"KRS 176.056","heading":"Light from outdoor fixtures not to encroach on agricultural land --","body":"Shielding -- Complaint -- Exception.\n(1) As used in this section:\n(a) \"Agricultural land\" means:\n1. Any tract of land, including all income -producing improvements, of at\nleast te n (10) contiguous acres in area used for the production of\nlivestock, livestock products, poultry, poultry products or the growing of\ntobacco or other crops including timber; or\n2. Any tract of land devoted to and meeting the requirements and\nqualifications for payments pursuant to agriculture programs under an\nagreement with the state or federal government;\n(b) \"Fully shielded\" means an outdoor light fixture that is shaded so that light\nrays emitted by the fixture, either directly from the lamp or indirectly from the\nfixture, are no longer encroaching on agricultural land; and\n(c) \"Outdoor light fixture\" means any light fixture owned or maintained by the\ncabinet.\n(2) The cabinet shall not allow light emitted from an outdoor light fixture to encroach\non any agricultural land, whether public or private.\n(3) Any new outdoor light fixture installed after April 13, 2026, which emits light that\nencroaches on agricultural land shall be fully shielded at the time of installation.\n(4) If light emitted from an outdoor light fixture encroaches on agricultural land, the\nowner of that land may submit a complaint in writing to the cabinet, and the cabinet\nshall ensure that the outdoor light fixture is fully shielded within thirty (30) days o f\nthe date of the submission of the written complaint.\n(5) This section shall not apply to outdoor light fixtures used by the cabinet or its\ncontractors incidental to a highway construction or maintenance project, provided\nthe encroachment lasts for no lon ger than one hundred eighty (180) days and that\nthe lights are turned off when not in active use for construction or safety purposes.","path":["KRS Chapter 176"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56871","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:26Z","sha256":"4038d7be0423a85b20a8b9c0df2cb2f209fb0c51fd92839c0d66b48def1f4d68","source_id":"us-ky","stale":false,"prev":"us-ky/krs-176.055","next":"us-ky/krs-176.057"},"notice":"GroundRules: Original legal text.
