{"data":{"id":"us-ky/krs-176.082","jurisdiction":"us-ky","citation":"KRS 176.082","heading":"Reciprocal preference to be given to resident bidders on construction","body":"projects.\n(1) Prior to a contract being awarded for the construction phase of a project, a resident\nbidder of the Commonwealth shall be given a preference against a nonresident\nbidder registered in any state that gives or requires a preference to bidders from that\nstate. The preference shall be equal to the preference given or required by the state\nof the nonresident bidder and shall be applied after the opening of the bids.\n(2) A re sident bidder is an individual, partnership, association, corporation, or other\nbusiness entity that, on the date the department advertises for bids:\n(a) Is authorized to transact business in the Commonwealth; and\n(b) Has for one (1) year prior to and thro ugh the date of advertisement, filed\nKentucky corporate or other business income taxes, made payments to the\nKentucky unemployment insurance fund established in KRS 341.490, and\nmaintained a Kentucky workers' compensation policy in effect.\n(3) A nonresident bidder is an individual, partnership, association, corporation, or other\nbusiness entity that does not meet the requirements of subsection (2) of this section.\n(4) The department shall use the list and administrative regulations described in KRS\n45A.494(6) to determine the preferences to be given in awarding a contract.\n(5) The preference shall not be given if the preference conflicts with federal law.","path":["KRS Chapter 176"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5171","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:27Z","sha256":"e420eaebec17acca8e1a91b9f145133a2a54a781bb135d32ff63460efec9515e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-176.080","next":"us-ky/krs-176.085"},"notice":"GroundRules: Original legal text.
