{"data":{"id":"us-ky/krs-176.090","jurisdiction":"us-ky","citation":"KRS 176.090","heading":"Provisions of contract -- Partial and complete payment -- Bonds, bids, etc.,","body":"to be filed.\n(1) The contract shall state the time when the work shall be begun and completed, and\nthe time and manner of payment. The department may require that a certain p ercent\nof the contract price, or a certain fixed sum shall not be paid to the contractor until a\nfixed time after completion and acceptance of the work.\n(2) When the contract provides for partial payment based on the amount of work done,\nthe representative  of the department in charge of the work shall present to the\ndepartment, as each payment becomes due, a certificate signed by him, showing as\nnearly as possible the amount of work done for which payment is to be made. If the\nstate highway engineer finds t hat the amount certified is due, the Finance and\nAdministration Cabinet shall draw a warrant for the amount certified, on the request\nof the Department of Highways.\n(3) When the work has been fully completed, the representative of the department shall\ncertify to the department a detailed and itemized statement of the cost of the work\ndone, and if it is found to be correct, the department shall certify the amount to the\nFinance and Administration Cabinet, which shall draw a warrant for the amount\ndue.\n(4) All bonds and bids filed and all contracts approved by the department and a copy of\nall specifications and certifications shall be kept on file in the office of the\ndepartment.","path":["KRS Chapter 176"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5173","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:27Z","sha256":"62bed4bd70b5d7895955ac7d306aac71702751c8a70c1858a1d8b27082629f66","source_id":"us-ky","stale":false,"prev":"us-ky/krs-176.085","next":"us-ky/krs-176.095"},"notice":"GroundRules: Original legal text.
