{"data":{"id":"us-ky/krs-176.150","jurisdiction":"us-ky","citation":"KRS 176.150","heading":"Information required with application for certificate of eligibility.","body":"(1) No applicant shall be given a certificate of eligibility unless his financial statement\nand the investigation made by the department show that he possesses net current\nassets or working capital sufficient in the judgment of the department to render it\nprobable that he can satisfactorily execute his contracts and meet obligations therein\nincurred. All applications for certificates shall expressly authorize the department to\nobtain all information which it deems pertinent with respect to the financial status,\nassets, and liabilities of the applicant from any persons having business transactions\nwith the applicant, and shall expressly authorize all those persons to furnish any\ninformation requested from them by the department.\n(2) No applicant shall be given a certificate of eligibility until the applicant provides the\nsecretary of the Transportation Cabinet with his sworn statement made under\npenalty of perjury that he has not knowingly violated any provision of the campaign\nfinance laws of the Commonwealth and that the award of a contract to the applicant\nwill not violate any provision of the campaign finance laws of the Commonwealth.\n\"Knowingly\" means, with respect to conduct or to a circumstance described by a\nstatute defining an offense, that a person is awa re or should have been aware that\nhis conduct is of that nature or that the circumstance exists.\n(3) Certificates of eligibility shall be issued without reference to the residence of\napplicants and the administrative regulations regarding the issuance of c ertificates\nshall apply equally to residents and nonresidents. A certificate of eligibility shall not\nbe denied to any applicant upon the sole issue of nationality or residence.\n(4) When the applicant is a foreign corporation, limited liability company, or  limited\npartnership, the application shall be accompanied by a certificate from the Secretary\nof State of the jurisdiction in which it is organized certifying that it is validly\nexisting and in good standing and a certificate from the Kentucky Secretary o f State\ncertifying that it is authorized to transact business in the Commonwealth of\nKentucky.","path":["KRS Chapter 176"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5185","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:27Z","sha256":"83bbef1082188b0b403605bdfd122420d06e5d197d85e94e351e96df81432e50","source_id":"us-ky","stale":false,"prev":"us-ky/krs-176.140","next":"us-ky/krs-176.160"},"notice":"GroundRules: Original legal text.
