{"data":{"id":"us-ky/krs-176.431","jurisdiction":"us-ky","citation":"KRS 176.431","heading":"Transportation Cabinet's authorization for demonstration road and","body":"bridge related projects in each fiscal year -- Bidding process and basis of\nselection for projects -- Annual report to Interim Joint Committee on\nAppropriations and Revenue.\n(1) (a) Notwithstanding any conflicting provisions of this chapter and KRS Chapters\n45A and 177, each fiscal year, the Transportation Cabinet is authorized to\nutilize design/build procurement methods for up to:\n1. Five (5) major demonstration road and bridge  related projects, with a\ntotal cost of each project not to exceed three hundred million dollars\n($300,000,000); and\n2. Ten (10) demonstration road and bridge related projects, with a total\ncost of each project not to exceed seventy -five million dollars\n($75,000,000).\n(b) The projects outlined in this subsection shall be identified in the biennial\nhighway construction plan.\n(2) For procurement purposes, the Transportation Cabinet shall utilize a qualifications -\nbased bidding process within the context of the  provisions of this chapter. The\nprojects shall be selected based on engineering factors that determine a design/build\nprocess will provide the best value for the Commonwealth. Factors to consider may\ninclude but not be limited to the following: project de livery schedule, technical\ncomplexity, constructability, and estimated project cost.\n(3) The secretary of the Transportation Cabinet shall determine the nature and scope of\neach design/build project, and shall submit a report identifying and detailing the\ndemonstration road and bridge related projects, including the estimated cost\nsavings, to the Interim Joint Committee on Appropriations and Revenue by\nDecember 1 of each fiscal year.","path":["KRS Chapter 176"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47666","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:27Z","sha256":"da3c0fbae87b03e3c8160ff7077a8412aa443738b31a1a581440b0e875015f2f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-176.430","next":"us-ky/krs-176.432"},"notice":"GroundRules: Original legal text.
