{"data":{"id":"us-ky/krs-177.020","jurisdiction":"us-ky","citation":"KRS 177.020","heading":"State primary roads to be designated and controlled by the Department of","body":"Highways -- Notice to fiscal court and affected citizens -- Rural secondary road\nsystem -- Maintenance -- Administrative regulations.\n(1) The state primary road system shall cons ist of such public roads and city streets\nwithin the state as the Department of Highways determines shall be established,\nconstructed, or maintained by the Department of Highways.\n(2) The department shall, in its discretion, determine which public roads, o r city streets,\nshall be established, constructed, or maintained by it, and shall determine the type\nof construction or maintenance for that road or city street.\n(3) In the establishment of the state primary road system, the Department of Highways\nis authorized to select new routes, deviate from an existing route whenever it deems\nsuch deviation proper, eliminate from the state primary system roads or city streets\nwhich have been replaced as proper part of the system by the construction of a new\nfacility or the selection of a new route. No permanent ingress or egress ramp of the\nstate primary road system on fully controlled access facilities shall be closed, except\nfor repairs, unless a public hearing is first held in the area to be affected by the\nclosing. The Department of Highways shall, at least twenty (20) days before the\nhearing, advertise in a newspaper of general circulation in the area to be affected by\nthe closing, the date, time, and place of the hearing.\n(4) Prior to the advertisement for bids on any highway construction project, the\nDepartment of Highways shall meet with the fiscal court in the jurisdiction of the\nconstruction project for the purpose of advising the fiscal court of any state road or\nroad segment which the department may seek to el iminate from the state primary\nroad system upon completion of that highway construction project. The requirement\nof this subsection shall be in addition to the requirements of subsection (5) of this\nsection.\n(5) The department shall notify the fiscal court  of the county at least four (4) months\nbefore it eliminates a road, road segment, bridge, or street in that county from the\nstate primary road system. Upon receiving notice, the fiscal court may reject title\nand notify the department that the road shall n ot become part of the county road\nsystem. If the fiscal court declines, the department shall give notice to all private\npersons entitled to a necessary access over this road of their rights under this\nchapter; and, by petition of any private party entitled  to such access, the road shall\nbe deemed a discontinued state road and shall be closed to public use but remain\nopen in accordance with its condition and use for the access of the private parties\ninvolved. In the absence of such petition, title shall be t ransferred to the owner or\nowners of the tract or tracts of land to which the road originally belonged.\n(6) As used in this section, the term \"rural secondary roads\" shall mean the system of\nroads in this state which are usually considered farm -to-market roads and that are\nclassified as part of the rural secondary road system by the Department of\nHighways. The roads in the rural secondary system shall be maintained with the\nproceeds of the provisions of KRS 177.320(1) and in no case shall the rural\nsecondary system, as defined in this subsection, be less than eleven thousand eight\nhundred (11,800) miles.\n(7) The establishment, construction, or maintenance of the state primary road system\nshall be under the direction and control of the Department of Highways.  The\ncommissioner of highways is authorized to adopt regulations necessary to the\nadministration of this authority.","path":["KRS Chapter 177"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5231","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:27Z","sha256":"22316fc6a97c7db215515ee45741979d7f6b3821fea37d280780b042d0a52c9f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-177.010","next":"us-ky/krs-177.021"},"notice":"GroundRules: Original legal text.
