{"data":{"id":"us-ky/krs-177.077","jurisdiction":"us-ky","citation":"KRS 177.077","heading":"Limited supplemental guide signs -- Administrative regulations -- Criteria","body":"for approval -- Hearings -- Effect on pre-existing signs.\n(1) No later than February 1, 1999, the commissioner of the Department of Highways\nshall establish standards, procedur es, and forms for the making and approval of\napplications for a limited supplemental guide sign by the promulgation of\nadministrative regulations in accordance with KRS Chapter 13A.\n(2) The criteria for the approval of a limited supplemental guide sign app lication for an\nhistorical site or for a tourist area or attraction shall be based upon average annual\nattendance and distance from a fully controlled access highway interchange.\n(3) At a fully controlled access highway interchange in a rural area, the sta ndards for\napproval shall be the lesser of:\n(a) Tourist areas and attractions that have an average annual attendance of ten\nthousand (10,000) visitors and are located within fifty (50) miles of a fully\ncontrolled access highway;\n(b) Tourist areas and attra ctions that are located within fifty (50) miles of a fully\ncontrolled access interchange and have an annual visitation equal to or greater\nthan the average annual daily traffic count of the fully controlled access\nhighway at the interchange from which the attraction is served.\n(4) At a fully controlled access highway interchange in a city, the standards for\napproval shall be the lesser of:\n(a) Tourist areas and attractions that have an average annual attendance of\nseventy-five thousand (75,000) visitors and  are located within fifty (50) miles\nof a fully controlled access highway interchange;\n(b) Tourist areas and attractions that are located within fifty (50) miles of a fully\ncontrolled access highway interchange and have an annual visitation equal to\nthe average annual daily traffic count of the fully controlled access highway at\nthe interchange from which the attraction is served.\n(5) Historical sites that are located in either a rural area or a city shall have an average\nannual attendance of five thousand (5,000) and shall be located within fifty (50)\nmiles from a fully controlled access highway interchange.\n(6) The identification of a tourist area or attraction on a specific service sign pursuant to\nKRS 177.0736 shall not affect its eligibility for a limited supplemental guide sign.\n(7) Upon receipt of an application, the commissioner of the Department of Highways\nshall within thirty (30) days provide written notification to the applicant of any\nhearings pertaining to the application. The commissioner of th e Department of\nHighways shall make a determination on whether to approve the erection of a\nlimited supplemental guide sign within ninety (90) days after the receipt of an\napplication and shall provide written notification to the applicant of his decision.\n(8) Supplemental guide signs, including but not limited to limited supplemental guide\nsigns, erected prior to July 1, 1998, shall not be removed due to the site selection\ncriteria contained in KRS 177.076 to 177.079.","path":["KRS Chapter 177"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5264","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:28Z","sha256":"7317822c662ded65cd1007166aca78ac2c59170d1486e9595bf33fd829a86d2c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-177.076","next":"us-ky/krs-177.078"},"notice":"GroundRules: Original legal text.
