{"data":{"id":"us-ky/krs-177.170","jurisdiction":"us-ky","citation":"KRS 177.170","heading":"Division of costs -- Payment.","body":"(1) The cost of preparing the plans, specifications and estimates of cost and of\nadvertising for bids shall be paid wholly by the railroad company. The state shall\npay one -half (1/2) of the cost of the work within the right -of-way lines of the\nrailroad company, extended across the highway, and the railroad company shall pay\nthe other one -half (1/2) of the cost of the work lying within said lines. The\ndepartment shall pay the entire cost of all work lying beyond the right -of-way lines\nof the railroad.\n(2) As the work progresses the department shall furnish to the railroad company, and\nthe railroad company shall furnish to the department, a monthly statement showing\nin detail all amounts expended in connection with the work. On or about the\nfifteenth of each month  the state highway engineer shall prepare a statement\nshowing the total amount expended to the close of the preceding month, the amount\npaid or expended by each party up to that time, and the amount due from the\ndepartment to the railroad company or from the railroad company to the department.\nUpon receipt of the statement each party shall pay to the other the amounts shown\nto be due thereby.\n(3) All payments made on such monthly statements shall be considered only payments\non account, and upon final comple tion of the work the state highway engineer shall\nprepare and furnish to the railroad company a statement showing the total cost of\nthe work, the amount paid or expended by the department or the railroad company,\nand the amount due from one to the other. E ach party shall be afforded reasonable\nopportunities to verify the statements of expenditures by the other, and the balance\ndue as certified by the state highway engineer in his final statement shall be paid by\none (1) party to the other promptly upon receipt of such final statement.\n(4) The work lying within the right -of-way of the railroad shall be maintained at the\nexpense of the railroad company, but the railroad company shall not be required to\nkeep up the surface of the roadbed of the highway.","path":["KRS Chapter 177"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5290","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:28Z","sha256":"65ce1011d516dce73bd8b7f175c027bbc13c658baabdd8051ebab8be33363c65","source_id":"us-ky","stale":false,"prev":"us-ky/krs-177.160","next":"us-ky/krs-177.180"},"notice":"GroundRules: Original legal text.
