{"data":{"id":"us-ky/krs-177.250","jurisdiction":"us-ky","citation":"KRS 177.250","heading":"Acquisition of property and property rights -- Options to acquire --","body":"Administrative regulations.\n(1) For the purposes of KRS 177.220 to 177.310, the highway authorities of the state,\ncounty, or city may acquire private or public property and property rights for limited\naccess facilities and service roads, including rights of access, air, view, and light, by\ngift, devise, purchase, or condemnation in the same manner as such units are\nauthorized by law to acquire property or property rights in connection  with\nhighways and streets within their respective jurisdiction. Except as provided in\nsubsection (2) of this section, all property rights acquired under the provisions of\nKRS 177.220 to 177.310 shall be in fee simple. In connection with the acquisition\nof property or property rights for any limited access facility or portion thereof, or\nservice road in connection therewith, the state, county, or city highway authority\nmay, in its discretion, acquire an entire lot, block, or tract of land, if by so doing, the\ninterests of the public will be best served, even though said entire lot, block, or tract\nis not immediately needed for the right-of-way proper.\n(2) A city, county, or urban-county independently, or any combination of a city, county,\nor urban -county that have entered into an interlocal cooperative agreement under\nKRS 65.210 to 65.300, may purchase options to acquire property or property rights\non highways or streets within their respective jurisdictions if the property or\nproperty rights to be acquired are for highway projects included in:\n(a) The most recent twenty (20) year statewide transportation plan adopted by the\nTransportation Cabinet and submitted to the Federal Highway Administration;\n(b) The most recent six (6) year road plan enacted by the General Assembly;\n(c) The most recent long -range transportation plan adopted by a metropolitan\nplanning organization and submitted to the Transportation Cabinet; or\n(d) The most recent recommendations of an area development district\ntransportation committee t hat have been submitted to the Transportation\nCabinet.\n(3) The secretary of the Transportation Cabinet shall promulgate administrative\nregulations in accordance with KRS Chapter 13A to establish guidelines governing\nthe purchase of options under subsection (2) of this section.","path":["KRS Chapter 177"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5298","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:28Z","sha256":"6dee182b4629e2f542845de58a783d9c7fb3fe8e13ba6eb3acd6abc2a19c0500","source_id":"us-ky","stale":false,"prev":"us-ky/krs-177.240","next":"us-ky/krs-177.260"},"notice":"GroundRules: Original legal text.
