{"data":{"id":"us-ky/krs-177.360","jurisdiction":"us-ky","citation":"KRS 177.360","heading":"Allocation of funds for state -maintained roads -- Apportionments to be","body":"made on basis of revenue estimates -- Uniform financial information report\nrequired -- Procedures to identify project needs in unincorporated areas of\nconsolidated local governments.\n(1) Except as provided in subsection (5) of this section, the Department of Rural and\nMunicipal Aid shall allocate the funds set apart under KRS 177.320(1) for\nconstruction, reconstruction, and maintenance of state -maintained secondary and\nrural highways as follows:\n(a) One-fifth (1/5) shall be apportioned equally among the one hundred twenty\n(120) counties;\n(b) One-fifth (1/5) shall be apportioned among the one hundred twenty (120)\ncounties on the basis of the ratio which the rural population o f each county\nbears to the total rural population of the state. \"Rural population\" as used here\nmeans the population in a county outside cities, towns, and urban areas having\na population of twenty -five hundred (2,500) or more as shown by the most\nrecent decennial census of the United States Bureau of the Census, and county\npopulation shall be determined by the most recent decennial census of the\nUnited States Bureau of the Census;\n(c) One-fifth (1/5) shall be apportioned among the one hundred twenty (120)\ncounties on the basis of the ratio that the public road mileage outside of cities,\ntowns, and urban areas having a population of twenty -five hundred (2,500) or\nmore bears to the total mileage of such roads for the entire state; and\n(d) Two-fifths (2/5) sha ll be apportioned among the one hundred twenty (120)\ncounties on the basis of the ratio which the square -mile rural area of the\ncounty bears to the total square -mile rural area of the state. \"Rural area\" as\nused here means that area of the county outside o f cities, towns, and urban\nareas having a population of twenty -five hundred (2,500) or more and shown\nby the most recent decennial census of the United States Bureau of the\nCensus.\n(2) A sum not exceeding six percent (6%) of the allocation provided by KRS\n177.320(1) to each county shall be deducted at the beginning of each fiscal year and\nadjusted quarterly to cover the maintenance, administrative, engineering, and other\ncosts of the program.\n(3) Of the total amount apportioned by the provisions of this sec tion, a sum not\nexceeding six percent (6%) may be deducted and placed by the Department of\nRural and Municipal Aid in a special emergency account to be expended at the\ndirection of the commissioner to meet unforeseen emergencies on rural and\nsecondary roads and bridges.\n(4) Apportionments as required by the provisions of this section shall be made on the\nbasis of revenue estimates supplied by the Finance and Administration Cabinet and\nadjusted quarterly in accordance with the most recent revision of the est imates by\nthe Finance and Administration Cabinet.\n(5) Any county eligible to receive county road aid moneys in accordance with KRS\n177.320 and this section shall be required to submit a uniform financial information\nreport to the Department for Local Gover nment in accordance with KRS 65.905\nbefore any payment of county road aid funds shall be made. The Department for\nLocal Government shall notify the Department of Rural and Municipal Aid no later\nthan March 1 annually of any county that has not submitted a uniform financial\ninformation report. The Department of Rural and Municipal Aid shall, upon\nnotification by the Department for Local Government, immediately suspend all\ncounty road aid moneys to the county until the county complies with the provisions\nof KRS 65.900 to 65.925 and submits the uniform financial information report to\nthe Department for Local Government. The Department for Local Government\nshall immediately notify the Department of Rural and Municipal Aid to reinstate\ncounty road aid moneys to a ny county affected by this subsection as soon as the\ncounty submits the uniform financial information report.\n(6) In distributing county road aid funds received by a consolidated local government\nestablished under KRS Chapter 67C, a consolidated local gove rnment shall\nestablish procedures to identify project needs in unincorporated areas that prioritize\nconsideration of the following factors:\n(a) Population growth;\n(b) Population density; and\n(c) Economic development potential.","path":["KRS Chapter 177"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55510","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:29Z","sha256":"bd14ff5b634c6dd97e8a545c45ff6d3f2af2f11157974501311f73e2df63ff58","source_id":"us-ky","stale":false,"prev":"us-ky/krs-177.350","next":"us-ky/krs-177.365"},"notice":"GroundRules: Original legal text.
