{"data":{"id":"us-ky/krs-177.390","jurisdiction":"us-ky","citation":"KRS 177.390","heading":"Definitions for KRS 177.390 to 177.570.","body":"As used in KRS 177.390 to 177.570, the following words and terms shall have the\nfollowing meanings, unless the context shall indicate another or different meaning or\nintent:\n(1) The word \"department\" shall mean the Department of Highways, or, if said\ndepartment shall be abolished, the department, board, body, or commission\nsucceeding to the principal functions thereof or to whom the powers given by KRS\n177.390 to 177.570 to the department shall be given by law;\n(2) The word \"project\" or the words \"turnpike project\" shall mean any express highway\nor superhighway or such part or parts thereof as may be constructed under the\nprovisions of KRS 177.390 to 177.570 by the department, including all bridges,\ntunnels, overpasses, underpasses, interchanges, entrance pl azas, approaches,\nconnecting highways, tollhouses, service stations, garages, restaurants, and\nadministration, storage, and other buildings and facilities which the department may\ndeem necessary for the operation of such project, together with all property , rights,\neasements, and interests which may be acquired by the department for the\nconstruction or the operation of such project;\n(3) The word \"cost\" as applied to a turnpike project shall embrace the cost of\nconstruction, the cost of the acquisition of al l land, rights of way, property, rights,\neasements, and interests acquired by the department for such construction, the cost\nof demolishing or removing any buildings or structures on land so acquired,\nincluding the cost of acquiring any lands to which such  buildings or structures may\nbe moved, the cost of all machinery and equipment, financing charges, provision for\nworking capital in such amount as the department shall determine to be reasonable,\ninterest prior to and during construction, and, if deemed ad visable by the\ndepartment, for a period not exceeding two (2) years after completion of\nconstruction, cost of traffic estimates and of engineering and legal expenses, plans,\nspecifications, surveys, estimates of cost and of revenues, other expenses necessa ry\nor incident to determining the feasibility or practicability of constructing any such\nproject, administrative expense, and such other expense as may be necessary or\nincident to the construction of the project, the financing of such construction, and\nthe placing of the project in operation. Any obligation or expense heretofore or\nhereafter incurred by the department for traffic surveys, borings, preparation of\nplans and specifications, engineering, and other services in connection with the\nconstruction of a project shall be regarded as a part of the cost of such project and\nmay be reimbursed to the Commonwealth out of the proceeds of turnpike revenue\nbonds hereinafter authorized in KRS 177.400 to 177.570;\n(4) The words \"public highways\" shall include all public highways, roads, and streets in\nthe Commonwealth, whether maintained by the Commonwealth or by any county,\ncity, town, or other political subdivision;\n(5) The word \"bonds\" or the words \"turnpike revenue bonds\" shall mean revenue bonds\nof the Commonwealth authorized under the provisions of KRS 177.390 to 177.570;\n(6) The word \"owner\" shall include all individuals, copartnerships, associations, or\ncorporations having any title or interest in any property, rights, easements, and\ninterests authorized to be acquired by KRS 177.390 to 177.570.","path":["KRS Chapter 177"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5325","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:29Z","sha256":"a854126a88dcb11fedf255613d31ff9362b0176b9b52d6c4b163eca759dd437c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-177.380","next":"us-ky/krs-177.400"},"notice":"GroundRules: Original legal text.
