{"data":{"id":"us-ky/krs-177.572","jurisdiction":"us-ky","citation":"KRS 177.572","heading":"Definitions for KRS 177.571 to 177.576.","body":"As used in KRS 177.571 to 177.576, unless the context requires otherwise:\n(1) \"Advertising device\" means as defined in KRS 177.830;\n(2) \"Archaeological quality\" means those characteristics of the area surrounding a\nscenic byway or a scenic highway that are  physical evidence of historic or\nprehistoric human life or activity and that are visible and capable of being\ninventoried and interpreted. The archaeological interest, as identified through ruins,\nartifacts, structural remains, or other physical evidence shall have scientific\nsignificance that educates the viewer and causes the viewer to appreciate the past;\n(3) \"Cultural quality\" means evidence or expressions of the customs or traditions of a\ndistinct group of people. Cultural features shall include, but not be limited to, crafts,\nmusic, dance, rituals, festivals, speech, food, special events, and vernacular\narchitecture, as currently practiced. The cultural qualities of the area surrounding a\nscenic byway or scenic highway may highlight one (1) or more si gnificant\ncommunities or ethnic traditions;\n(4) \"Historic quality\" means legacies of the past that are distinctly associated with the\nphysical elements of the landscape, whether natural or manmade, and that are of\nhistoric significance, educate the viewer,  and cause the viewer to appreciate the\npast. The historic qualities reflect the actions of people and may include buildings,\nsettlement patterns, or other examples of human activity. Historic qualities may be\ninventoried, mapped, and interpreted, and they  possess integrity of location, design,\nsetting, material, workmanship, feeling, and association;\n(5) \"Intrinsic quality\" means one (1) or more of the following:\n(a) Archaeological quality;\n(b) Cultural quality;\n(c) Historic quality;\n(d) Natural quality;\n(e) Recreational quality; or\n(f) Scenic quality;\n(6) \"Natural quality\" means those features in the visual environment that are in a\nrelatively undisturbed state. These features shall predate the arrival of human\npopulations and may include geological format ions, fossils, landforms, water\nbodies, vegetation, and wildlife. If there is evidence of human activity, the natural\nfeatures must reveal minimal disturbances;\n(7) \"Outdoor advertising device\" means an advertising device that is not located on the\npremises of the entity being advertised;\n(8) \"Recreational quality\" means outdoor recreational activities directly associated with\nand dependent upon the natural and cultur al elements of the scenic byway or scenic\nhighway's landscape. The recreational activities shall provide opportunities for\nactive and passive recreational experiences including, but not limited to, downhill\nskiing, rafting, boating, fishing, hiking, and si mple roadway driving. The\nrecreational activities may be seasonal, but the quality and importance of the\nactivities as seasonal operations shall be well recognized;\n(9) \"Scenic byway\" means a highway maintained by a local government that has\nroadsides or v iew sheds of aesthetic, cultural, historical, or archaeological value\nworthy of preservation, restoration, protection, or enhancement;\n(10) \"Scenic highway\" means a state -maintained highway that has roadsides or view\nsheds of aesthetic, cultural, historica l, or archaeological value worthy of\npreservation, restoration, protection, or enhancement; and\n(11) \"Scenic quality\" means the heightened visual experience derived from the view of\nthe natural and manmade elements of the scenic byway or scenic highway. Th e\ncharacteristics of the landscape are strikingly distinct and offer a pleasing and\nmemorable visual experience.
