{"data":{"id":"us-ky/krs-178.010","jurisdiction":"us-ky","citation":"KRS 178.010","heading":"Definitions -- Construction of chapter -- Minimum requirement for gift.","body":"(1) As used in this chapter, unless the context otherwise requires:\n(a) \"Construction\" includes reconstruction and improvement;\n(b) \"County roads\" are public roads which have been formally accepted by the\nfiscal court of the county as a part of the county roa d system, or private roads,\nstreets, or highways which have been acquired by the county pursuant to\nsubsection (3) of this section or KRS 178.405 to 178.425. \"County roads\"\nincludes necessary bridges, culverts, sluices, drains, ditches, waterways,\nembankments or retaining walls; and\n(c) \"Hard surface road\" means a road the surface of which is asphalt, brick, stone\nblock, macadam, concrete, gravel or other material of equal merit.\n(2) Nothing in this chapter shall be construed to take from the jurisdiction o r control of\nthe legislative body of any incorporated city any road, bridge, landing or wharf, or\nany other thing exclusively under the jurisdiction or control of the city.\n(3) Nothing in this chapter shall prevent any fiscal court from acquiring unimprove d\nland by gift for public purposes. However, on and after July 13, 2004, a fiscal court\nmay only accept a private road, street, or highway by gift if the private road, street,\nor highway has been constructed to meet minimum construction standards\nestablished by the fiscal court.\n(4) Nothing in this chapter, including the fact that a municipal street has not been\naccepted into the county road system, shall prevent any county from entering into an\nagreement, pursuant to the provisions of KRS 65.210 to 65.300,  with any city\nlocated within the county to perform work upon or to provide personnel, materials\nor equipment for work to be performed upon any street located within the city. A\ncounty may pay one hundred percent (100%), or a lesser percentage, of all or a ny\npart of the cost of the joint undertaking, based upon the terms agreed to in the\ninterlocal cooperative agreement required by this subsection.","path":["KRS Chapter 178"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5416","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:30Z","sha256":"8a78b72ef355682ce9270bab399a1e7c95c98edaada70c83602f2366a4f54c91","source_id":"us-ky","stale":false,"prev":"us-ky/krs-177.999","next":"us-ky/krs-178.020"},"notice":"GroundRules: Original legal text.
