{"data":{"id":"us-ky/krs-178.025","jurisdiction":"us-ky","citation":"KRS 178.025","heading":"Road presumed established -- Presumption of width and area of public","body":"road right-of-way.\n(1) Any road, street, highway, or parcel of ground, dedicated and laid -off as a public\nway and used without restrictions on a continuous basis by the general publi c for\nfifteen (15) consecutive years, shall conclusively be presumed to be a public road.\n(2) In the absence of any record, the width of a public road right -of-way shall be\npresumed to extend to and include that area lying outside the shoulders and ditch\nlines and within any landmarks such as fences, fence posts, cornerstones, or other\nsimilar monuments indicating the boundary lines.\n(3) In the absence of both record or landmark, the right-of-way of a public road shall be\ndeemed to extend to and include the  shoulders and ditch lines adjacent to said road\nand to the top of cuts or toe of fills where such exist.","path":["KRS Chapter 178"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5418","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:30Z","sha256":"22611f2826b382d6cc89bc5d64539123dd3eb2b25e5104ab3c5c19a0ffbed0bd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-178.020","next":"us-ky/krs-178.030"},"notice":"GroundRules: Original legal text.
