{"data":{"id":"us-ky/krs-178.080","jurisdiction":"us-ky","citation":"KRS 178.080","heading":"Establishment and alteration of public roads, bridges and landings, upon","body":"petition.\n(1) When any person desires the establishment or alteration of a public road, bridge or\nlanding, he shall petition the fiscal court setting forth in his petition specif ically the\nnature and location of the proposed work. The court shall thereupon appoint two (2)\nviewers who, together with the county road engineer, shall view the ground and\nreport in writing the advantages and disadvantages which, in their opinion, will\nresult to the individual and to the public from the proposed work and the grades and\nbearings of the proposed road, and other facts and circumstances that may enable\nthe fiscal court to determine whether the work ought to be undertaken by the\ncounty.\n(2) If the petition is for the establishment or alteration of a public road leading from a\nmain public road, the report shall set out whether such road should be established,\nstating specifically whether it would be necessary to take any burying ground,\ngarden, yard, orchard, or any part thereof, or to injure or destroy any buildings and\nthe probable cost of the work, the names of the landowners whose property would\nhave to be taken or injured, which of them would require compensation and the\nprobable amount to w hich each would be entitled. They shall make careful\nexamination of routes or locations other than that proposed or petitioned for,\nkeeping in view the possible future development of the county and the\naccommodations of the general traveling public, and sh all report to the fiscal court\nat a public meeting in favor of the one they prefer, giving reasons for the preference.\nA map giving the grades and bearings of the routes or locations shall be returned\nwith the report.\n(3) If it appears to the fiscal court that the interests of the general public may be\nfurthered thereby, the fiscal court shall personally examine the proposed work. If\nthe court decides to undertake the proposed work the county judge/executive shall\nappoint a day for hearing the parties inter ested, and cause notices thereof to be\ngiven to all interested parties.\n(4) If the county judge/executive at any time has sufficient evidence before him to\nenable him to ascertain what would be a just compensation to the proprietors and\ntenants, and if the  proprietors and tenants are willing to accept what the county\njudge/executive deems just, the county judge/executive, upon such acceptance being\nreduced to writing and signed by the proprietors and tenants, may determine to\nundertake the work, subject to the consent and approval of the fiscal court.","path":["KRS Chapter 178"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5424","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:30Z","sha256":"66a0e012ecb20bafc64aea71ee1885c96d469957f98fe1f56ef3d0d4436aefdd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-178.070","next":"us-ky/krs-178.090"},"notice":"GroundRules: Original legal text.
