{"data":{"id":"us-ky/krs-178.310","jurisdiction":"us-ky","citation":"KRS 178.310","heading":"County roads taken for railroad purposes -- Correction of unsafe","body":"conditions.\n(1) The fiscal court of a county in which any county road or portion thereof is taken for\nrailroad purposes may, upon petition of any party interested, served upon the\nrailroad company as any other civil process, appoint a committee of three (3) to\ninquire whether the road or portion thereof is unsafe for travel by reason of the\nrailroad, and whether an alteration of the old road or the construction of a new road\nis necessary.\n(2) The committee shall examine the place where the danger is complained of, and shall\ngive fifteen (15) days' written notice to the persons making the complaint and the\npersons complained of, of an opportunity to be heard. After the hearing, the\ncommittee shall report its findings to the fiscal court, which may make an order\nconcerning the matter.\n(3) If the fiscal court orders any alteration or construction, and the railroad company\nfails to comply with the order, the fiscal court shall have the work d one and may\nrecover the cost from the railroad company, in the same manner that the cost of\nremoving obstructions is recovered under KRS 179.280.\n(4) This section shall not apply to street railways or to public roads located in\nincorporated cities which h ave control of their roads, streets and alleys, or to roads\nwhich have been constructed since the railroad.","path":["KRS Chapter 178"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5452","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:30Z","sha256":"6db89141f45c1e1f0916904ffc65fb760dd451151a454f70760b73d237cf4ad2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-178.300","next":"us-ky/krs-178.320"},"notice":"GroundRules: Original legal text.
