{"data":{"id":"us-ky/krs-178.337","jurisdiction":"us-ky","citation":"KRS 178.337","heading":"Removal of road from system -- When city streets in system.","body":"(1) After an engineering and traffic investigation and the receipt of recommendations\nby the county road engineer, a county through road or a portion thereof established\nor maintained as provided in KRS 178.330 may be detached from the county\nthrough road syst em. The fiscal court or the consolidated local government shall\ncause the proposed deletion to be marked on a map to be deposited with county road\nengineer and to be open to public inspection. The same procedure set forth in KRS\n178.330 for the establishment or maintenance of a county through road system shall\nbe followed in the case of roads or portions of roads detached therefrom. Notice of\nthe proposed deletion from the system shall conform to KRS 424.130(1)(b). The\nfiscal court or the consolidated local  government may in its discretion detach or\nretain the road as a part of the county through road system. The decisions of the\nfiscal court or the consolidated local government made in accordance with this\nsection shall be final. Whenever any county through  road has been added or\ndetached from the county through road system in accordance with KRS 178.330 to\n178.337, the county road engineer shall accordingly amend the map of the county\nthrough road system, which map shall at all times be available for public  inspection\nin the office of the county road engineer. Nothing herein shall be construed as\nautomatically deleting from the county through road system any portion of the\nsystem in territory which becomes incorporated as a city or which becomes annexed\nto a city.\n(2) Nothing in this chapter shall be construed to take from the jurisdiction or control of\nthe legislative body of any incorporated city or consolidated local government, any\nroad, bridge, landing, or wharf, or any other thing exclusively under the jurisdiction\nor control of such city or a consolidated local government. Provided, however, that\nroads within a city in a county containing a city of the first class or a consolidated\nlocal government may be made a part of the county through road system, i n\naccordance with KRS 178.330 or 178.333, or both, with the agreement of the\nlegislative body of said city.\n(3) Nothing in this chapter shall prevent any fiscal court or a consolidated local\ngovernment from acquiring land by gift for public purposes.","path":["KRS Chapter 178"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43836","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:30Z","sha256":"4888b3047701693bf72a7fc7bedec3c48c2d68bd8b73d75ba51953c9c1b6754c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-178.333","next":"us-ky/krs-178.350"},"notice":"GroundRules: Original legal text.
