{"data":{"id":"us-ky/krs-179.480","jurisdiction":"us-ky","citation":"KRS 179.480","heading":"Dust control treatment of county road by producers transporting natural","body":"resources thereon.\n(1) Upon a finding by the fiscal court that there exists an unabated dust nuisance on a\ncounty road resulting from the transportation of natural resources by tr uck, said\ncourt may require the producers of the natural resources that are being hauled on\nsaid road to treat said road to control dust. Said producer or producers shall be\nnotified of the fiscal court's finding by certified mail and shall be afforded a\nreasonable opportunity to treat said road to control dust prior to the county fiscal\ncourt initiating dust control treatment.  The cost of treatment shall be apportioned\namong all producers of natural resources using said road.  If a producer does not pay\nhis proportionate share within sixty (60) days of the mailing of the bill, the fiscal\ncourt may prohibit the movement of the producer's natural resources on county\nroads until the charges are paid.\n(2) The proportionate share of costs of any producer shall  be determined as the\npercentage which the tonnage of natural resources hauled by or for the producer\nover county roads bears to the total tonnage of natural resources hauled on the\ncounty roads.  The fiscal court shall consult with producers to devise an equitable\nmethod for determining proportionate cost shares before instituting charges, but the\nfiscal court shall be the final authority in determining proportionate costs.\n(3) Treatment of county roads for dust pursuant to this section shall not include paving,\nor laying of rock.","path":["KRS Chapter 179"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5522","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:31Z","sha256":"0808beeec5a88097d2a978f92c2a2dfa1a31827dc1f68a6876227818d1fc9a56","source_id":"us-ky","stale":false,"prev":"us-ky/krs-179.470","next":"us-ky/krs-179.700"},"notice":"GroundRules: Original legal text.
