{"data":{"id":"us-ky/krs-183.122","jurisdiction":"us-ky","citation":"KRS 183.122","heading":"Condemnation -- Effect on zoning of adjacent property.","body":"(1) Where necessary, in order to provide unobstructed air space for the landing and\ntaking off of aircraft utilizing airports acquired or operated under the provisions of\nthis chapter, the cabinet is hereby granted authority to condemn and acquire, in the\nsame manner as is provided for the acquisition of property for airport purposes,\neasements through or other interests in air space over land or water, interests in\nairport hazards outside the boundaries of the airports and such other airport\nprotection privile ges, together with rights of ingress and egress thereto and\ntherefrom, as are necessary to insure safe approaches to the landing areas of said\nairports and the safe and efficient operation thereof. The cabinet is authorized to\nacquire, in the same manner, the right or easement, for a term of years or\nperpetually, to place or maintain suitable marks for the daytime marking and\nsuitable lights or marks for the night marking of airport hazards, including the right\nof ingress and egress to and from such airport  hazards for the purpose of\nmaintaining and repairing such lights and marks.\n(2) The secretary may, by order, authorize any airport board or governmental unit to\ncondemn and acquire, with the full power of the Commonwealth, in the manner\nprovided in the Em inent Domain Act of Kentucky, any of the interests, easements,\nairport protection privileges, interests in air space, rights, or hazard marking\nprivileges described in subsection (1), or any real or personal property. Any\ncondemnation proceeding which may be necessary for such acquisition, if filed\nunder this subsection, shall be filed in the name of the Commonwealth on relation\nof the secretary of transportation, and of the airport board or governmental unit\nmaking such acquisition.\n(3) The authority granted in subsections (1) and (2) shall not be so construed as to limit\nthe right, power, or authority of the state or any municipality or governmental unit\nto zone property adjacent to any airport pursuant to any law of this state.","path":["KRS Chapter 183"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5731","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:34Z","sha256":"bb8a65dc19de165cb9812d741e8a1c506b5c6eb0a3993a200048ac0d576676d5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-183.121","next":"us-ky/krs-183.123"},"notice":"GroundRules: Original legal text.
