{"data":{"id":"us-ky/krs-184.355","jurisdiction":"us-ky","citation":"KRS 184.355","heading":"Powers of district.","body":"A transportation improvement district may:\n(1) Adopt bylaws for the regulation of its affairs and the conduct of its business;\n(2) Adopt an official seal;\n(3) Sue and be sued in its own name, plead and be impleaded, provided any actions\nagainst the district shall be brought in the Circuit Court of the county in which the\nprincipal office of the district is located, or in the Circuit Court of the county in\nwhich the cause of action arose, and all summonses, exceptions, and notices of\nevery kind shall be served on the district by leaving a copy thereof at  its principal\noffice with the secretary-treasurer;\n(4) Purchase, construct, maintain, repair, sell, exchange, police, operate, or lease\nprojects;\n(5) Issue transportation improvement district revenue bonds for the purpose of\nproviding funds to pay the costs of any project or part thereof;\n(6) Maintain such funds as it considers necessary;\n(7) Direct its agents or employees, when properly identified in writing and after at least\nfive (5) days' written notice, to enter upon lands within its jurisdiction to m ake\nsurveys and examinations preliminary to the location and construction of projects\nfor the district, without liability of the district or its agents or employees except for\nactual damage done;\n(8) Make and enter into all contracts and agreements necessa ry or incidental to the\nperformance of its functions and the execution of its powers under KRS 184.350 to\n184.395;\n(9) Employ, retain, or contract for the services of consulting engineers, superintendents,\nmanagers, and such other engineers, construction a nd accounting experts, financial\nadvisers, trustees, marketing, remarketing, and administrative agents, attorneys, and\nother employees, independent contractors, or agents as are necessary in its judgment\nand fix their compensation, provided all such expens es shall be payable solely from\nthe proceeds of bonds or from revenues;\n(10) Receive and accept from the federal or any state or local government, including but\nnot limited to any agency, entity, or instrumentality of any of the foregoing, loans\nand grants for or in aid of the construction, maintenance, or repair of any project,\nand receive and accept aid or contributions from any source or person of money,\nproperty, labor, or other things of value, to be held, used, and applied only for the\npurposes for wh ich such loans, grants, and contributions are made. Nothing in this\nsubsection shall be construed as imposing any liability on this state for any loan\nreceived by a transportation improvement district from a third party unless this state\nhas entered into an agreement to accept such liability;\n(11) Subject to the requirements of KRS 184.360, acquire, hold, and dispose of property\nin the exercise of its powers and the performance of its duties under KRS 184.350\nto 184.395; and\n(12) Do all acts necessary and p roper to carry out the powers expressly granted in KRS\n184.350 to 184.395.","path":["KRS Chapter 184"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53015","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:36Z","sha256":"47a31676dbe4992fab7bb30414fae3ca63ffc3fb93c71dde03797528d01a1872","source_id":"us-ky","stale":false,"prev":"us-ky/krs-184.353","next":"us-ky/krs-184.357"},"notice":"GroundRules: Original legal text.
