{"data":{"id":"us-ky/krs-186.032","jurisdiction":"us-ky","citation":"KRS 186.032","heading":"Voluntary inclusion of information that an owner, lesser, or operator of a","body":"motor vehicle is deaf or hard of hearing or has a communication disorder in\nKentucky vehicle registration system database -- Deaf or hard of hearing\nprotection trust fund -- Notice of availability of database designation.\n(1) As used in this section, \"communication disorder\" means a health condition or\ndisability that may impede effective communication with a peace officer.\n(2) The owner or lessee of a motor vehicle  may inform the county clerk that he or she,\nor someone who may be operating the vehicle, is deaf or hard of hearing and\nrequest that information be included in the Kentucky vehicle registration system\ndatabase to assist law enforcement in identifying the operator of the vehicle as\npossibly being deaf or hard of hearing.\n(3) The owner or lessee of a motor vehicle may inform the county clerk that he or she,\nor someone who may be operating the vehicle, has a communication disorder and\nrequest that information  be included in the Kentucky vehicle registration system\ndatabase to assist law enforcement in identifying the operator of the vehicle as\npossibly having a communication disorder.\n(4) (a) The deaf or hard of hearing protection trust fund is created as a se parate trust\nfund in the State Treasury. The trust fund shall consist of any proceeds from\ngifts, grants, contributions, appropriations, or other moneys made available\nfor the purposes of the trust fund.\n(b) The fund shall be administered by the Kentucky C ommission on the Deaf or\nHard of Hearing.\n(c) Notwithstanding KRS 45.229, trust fund amounts not expended at the close of\na fiscal year shall not lapse but shall be carried forward to the next fiscal year.\n(d) Any interest earnings of the trust fund shall become part of the trust fund and\nshall not lapse.\n(e) Trust fund moneys deposited in this fund shall only be used to:\n1. Reimburse the Transportation Cabinet for the cost of including\ninformation that someone is deaf or hard of hearing or has a\ncommunication disorder in the Kentucky vehicle registration system\ndatabase;\n2. Support other actions to protect the safety and welf are of persons who\nare deaf or hard of hearing or have a communication disorder; and\n3. Educate the public, the deaf and hard of hearing community, and the\ncommunication disorder community on issues confronting the deaf and\nhard of hearing and those with communication disorders.\n(5) (a) Every county clerk shall post a permanent notice containing information about\nthe availability of a deaf or hard of hearing or a communication disorder\ndesignation in the Kentucky vehicle registration database. The notice sh all be\nprinted in bold face type of sufficient point size to be read from a distance of\nat least three (3) feet. The notice shall be posted in a conspicuous place to\nensure that every person who enters the county clerk's office will readily see\nthe notice.\n(b) The Transportation Cabinet shall put information on its Web site about the\navailability of a deaf or hard of hearing or a communication disorder\ndesignation in the Kentucky vehicle registration database.","path":["KRS Chapter 186"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53391","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:36Z","sha256":"6e66447b5a4b42367ea75017d1802c54adec72971d3275bc6c18713cfffb379d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-186.030","next":"us-ky/krs-186.035"},"notice":"GroundRules: Original legal text.
