{"data":{"id":"us-ky/krs-186.040","jurisdiction":"us-ky","citation":"KRS 186.040","heading":"Issuance of certificate of registration -- Plates -- Clerk's fee -- Donations to","body":"child care assistance account -- Additional fees and distribution.\n(Effective until January 1, 2027)\n(1) (a) Upon receiving the application and fe e, the county clerk shall issue to the\nowner a certificate of registration containing the information required by\nsubsection (2) of this section and a registration plate.\n(b) If the cabinet finds that there is a shortage of materials suitable for making\nplates, or that a substantial saving will result, it may require by an\nadministrative regulation promulgated in accordance with KRS Chapter 13A\nand with the approval of the Governor that the previously issued plates\ncontinue to be used for a designated period.\n(c) Except as provided in subsection (3) of this section and in KRS 186.162, for\nservices performed, the owner shall pay the county clerk the sum of six\ndollars ($6) for each registration, or if the registration exceeds a twelve (12)\nmonth period, the clerk shall receive a fee of nine dollars ($9).\n(2) The certificate of registration shall contain the registration number, the name and\npost office address of the owner, and such other information as the cabinet may\nrequire.\n(3) Thirty dollars ($30) of the registration fee under KRS 186.050 for a motor vehicle\nthat has a declared gross vehicle weight with any towed unit of forty -four thousand\nand one (44,001) pounds or greater shall be distributed to the county clerk of the\ncounty where the vehicle is registered.\n(4) (a) Any person requesting a certificate of registration or renewal of registration of\nany type of motor vehicle shall have the opportunity to donate one dollar ($1)\nto the child care assistance account.\n(b) The one dollar ($1) donation shall be a dded to the regular fee for vehicle\nregistration.\n(c) One (1) donation may be made per issuance or renewal of vehicle registration.\n(d) Donation to the child care assistance account shall be voluntary and may be\nrefused by the applicant at the time of the issuance or renewal of any vehicle\nregistration.\n(5) (a) The county clerk may retain five percent (5%) of fees collected for the child\ncare assistance account under subsection (4) of this section.\n(b) The remaining funds shall be deposited into a trust and agency account in the\nState Treasury to the credit of the Cabinet for Health and Family Services for\nthe exclusive use as follows:\n1. Funds shall be made available to the agencies that administer child care\nsubsidy funds; and\n2. Funds shall be used as determined by the cabinet for working families\nwhose income exceeds the state income eligibility limits for child day\ncare assistance.\n(6) (a) Except as provided in KRS 186.162, in addition to the registration fee\nprovided for county clerks in subsections (1) and (3) of this section, an\nadditional three dollars ($3) per registration shall be collected at the time of\nregistration.\n(b) This additional fee shall be distributed as follows:\n1. One dollar ($1) shall be placed in an agency fund to provide additional\nfunds exclusively for technological improvements or replacement of the\nAVIS system. The operation and maintenance of AVIS shall remain a s\ncurrently provided for from the operational budget of the Transportation\nCabinet and shall not be reduced below the 2005-2006 funding level;\n2. One dollar ($1) shall be placed in an agency trust fund to provide funds\nexclusively for technological improve ments to the hardware and\nsoftware in county clerk offices related to the collection and\nadministration of road fund taxes. The cabinet, in consultation with\ncounty clerks, shall allocate funds as necessary from this fund to be used\nfor this exclusive purpose; and\n3. One dollar ($1) shall be placed in a trust fund to be maintained by the\ncabinet to provide an unrestricted revenue supplement, for operations of\nthe office related to the collection and administration of road fund taxes,\nto county clerk offices  in counties containing a population of less than\ntwenty thousand (20,000), as determined by the decennial census, and\nfor no other purpose. Annually, by March 1, the cabinet shall calculate\nthe amount collected in the previous calendar year and distribute  the\nentire fund proportionate to each county that qualifies under this\nparagraph based on population. This revenue shall be considered current\nyear revenue when paid to the clerk and shall not be identified as excess\nfees from the previous year.\n(7) Any m otor vehicle registration cancelled for nonrenewal shall be subject to the\nprovisions of KRS 186.181.\n(8) (a) The owner of a motor vehicle for which the registration has been cancelled\nunder this section, or revoked under KRS 186A.040(5)(b), shall be subje ct to\na reinstatement fee of forty dollars ($40), payable to the county clerk.\n(b) The county clerk shall retain twenty dollars ($20) of the reinstatement fee and\nforward the remaining twenty dollars ($20) to the cabinet.\n(c) The portion of the reinstateme nt fee received by the cabinet under this\nsubsection as a result of a revocation under KRS 186A.040(5)(b) shall be\nplaced in an agency fund to provide additional funds exclusively for the\nestablishment, implementation, operation, maintenance, and any neces sary\nimprovements or replacement of the accessible online insurance verification\nsystem established under KRS 186A.040.\nEffective: June 27, 2025","path":["KRS Chapter 186"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56142","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:36Z","sha256":"60d30da45a3ef87d2c30ebe7bc9f6f95dbc30af0c92ac1887c1b0172595a6be3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-186.038","next":"us-ky/krs-186.041"},"notice":"GroundRules: Original legal text.
