{"data":{"id":"us-ky/krs-186.230","jurisdiction":"us-ky","citation":"KRS 186.230","heading":"County clerk's duties -- Lien on vehicle, effect -- Issuance of plate without","body":"collecting taxes and fees prohibited.\nThe county clerk shall see that KRS 186.005 to 186.260 are enforced. In so doing, the\nclerk shall:\n(1) Take all applications as provided in KRS 186.005 to 186.260;\n(2) Issue the receipts on blanks furnished by the cabinet;\n(3) Collect the fees due the state;\n(4) Distribute the registration plates furnished by the Transportation Cabinet and\nDepartment of Vehicle Regulation and kee p a complete public record of all\nregistrations for the county in the clerk's office;\n(5) (a) Report and remit each Monday to the Transportation Cabinet all moneys\ncollected during the previous week, together with an electronic copy of all\nreceipts issued by the clerk during the same period. The clerk shall make all\nforms of payment payable to the State Treasurer.\n(b) If the clerk fails to file the report and remit the moneys required under this\nsubsection within seven (7) days after the report and remittan ce are due, the\nclerk shall pay a penalty of one percent (1%) per month or fraction thereof on\nthe amount of money shown to be due on the report.\n(c) The cabinet may grant a county clerk an extension of up to ten (10) days to\nfile the report and remit all moneys. The extension must be requested prior to\nthe end of the seven (7) day period and shall begin to run at the end of that\nperiod.\n(d) All penalties collected under this subsection shall be paid into the State\nTreasury as a part of the revenue collected under KRS 186.005 to 186.260;\n(6) Account to the Transportation Cabinet for all registration plates and receipt forms\nconsigned to the cl erk, at such time or times as the Transportation Cabinet may\ndirect, and give the appropriate cabinet timely notice of a probable deficiency of\nplates or other supplies;\n(7) Place a lien on any vehicle or manufactured home for which the county clerk, in\ncollecting the taxes and fees due the state or county clerk, accepts in payment a\ncheck which is not honored upon presentment. The lien on the vehicle or\nmanufactured home under this subsection shall be for the amount of the check. A\nlien under this subsecti on shall be subordinate to any prior perfected lien, either\ncontractual or statutory;\n(8) Not permit a person to sell, trade, or transfer ownership of a motor vehicle or\nmanufactured home if evidence is presented to the county clerk that any lien exists\non the motor vehicle or manufactured home; and\n(9) Not issue to any manufacturer or dealer any registration plate other than a\nmanufacturer's or dealer's plate, or registration plate which is under a dealer\nassignment pursuant to KRS 186A.230, except when th e dealer registers a motor\nvehicle under a U -Drive-It permit, without collecting designated registration fees\nand applicable taxes.","path":["KRS Chapter 186"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57809","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:38Z","sha256":"21aa8fa49d4a1ccb8044acb144cc2a390e52a4ab832be6360de906de1cc342d9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-186.220","next":"us-ky/krs-186.232"},"notice":"GroundRules: Original legal text.
