{"data":{"id":"us-ky/krs-186.290","jurisdiction":"us-ky","citation":"KRS 186.290","heading":"Information on motor vehicle emissions test status and compliance.","body":"(1) The Department of Vehicle Regulation shall provide and receive information on the\nemissions test status of vehicles registered in the Commonwealth of Kentucky. The\nDepartment of Vehicle Regulation shall provide appropriate emissions test and\ncompliance sta tus to the Department of Information Systems for inclusion in the\nAVIS database.\n(2) Upon notification to the Department of Vehicle Regulation from a county air\npollution control district or the Energy and Environment Cabinet of expiration of a\nvehicle emi ssions compliance certificate, the Department of Vehicle Regulation\nshall immediately notify the person who owns the vehicle that unless evidence of\ncompliance is received within thirty (30) days, the department shall revoke the\nregistration of the motor vehicle until:\n(a) The person presents an emissions certificate to the county clerk and pays the\nreinstatement fee required under KRS 186.180; or\n(b) The person presents proof in the form of an affidavit stating, under penalty of\nperjury as set forth in KRS  523.030, that failure to obtain a current emissions\ncertificate is the result of the inoperable condition of the motor vehicle.\n(3) The provisions of this section and KRS 186.180, 186.990, 224.20 -760, and 224.20-\n765 shall not prevent the Transportation Ca binet, a county air pollution district, or\nthe Energy and Environment Cabinet from seeking the enforcement or operation of\nany other statute or ordinance that ensures the compliance of motor vehicles in the\nCommonwealth under KRS Chapter 186, KRS 224.20 -710 to 224.20 -765, or KRS\nChapter 77.\n(4) The provisions of this section and KRS 186.180, 186.990, 224.20 -760, and 224.20-\n765 shall apply to vehicles that are registered in a county authorized under KRS\n224.20-710 to 224.20-765 or KRS Chapter 77 to conduct vehicle emissions tests.","path":["KRS Chapter 186"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=6040","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:38Z","sha256":"4f3a03b372e47f5ee9bc85878faabe1714d02fd0f80c2ddd61a02faab19f6add","source_id":"us-ky","stale":false,"prev":"us-ky/krs-186.286","next":"us-ky/krs-186.400"},"notice":"GroundRules: Original legal text.
