{"data":{"id":"us-ky/krs-186.403","jurisdiction":"us-ky","citation":"KRS 186.403","heading":"Voluntary travel ID instruction permits, operator's licenses, commercial","body":"driver's licenses, and personal identification cards -- Application -- Fees --\nIssuance -- Administrative regulations.\n(1) The Transportation Cabinet shall develop a s ystem of issuing voluntary travel ID\ninstruction permits, operator's licenses, commercial driver's licenses, and personal\nidentification cards.\n(2) The development of the system identified in subsection (1) of this section shall\ninclude but not be limited to the:\n(a) Acquisition of equipment and information technology systems and services;\n(b) Modification, conversion, or upgrade of the cabinet's existing databases,\nequipment, and information technology systems;\n(c) Establishment of electronic connectivity with any other state's driver licensing\ndepartment, federal agency, national or regional association, or business.\nElectronic connectivity under this paragraph shall be limited to the sharing of\nthe minimum amount of information necessary to validate infor mation\nsupplied by an applicant, process the application, and produce and distribute\nthe identity document. The Transportation Cabinet shall limit any access to\nthe databases developed under this chapter in accordance with the Driver's\nPrivacy Protection Act, 18 U.S.C. sec. 2721;\n(d) Creation of a new design for operator's licenses, commercial driver's licenses,\ninstruction permits, and personal identification cards that will meet the\nminimum content, design, and security standards required under this section;\n(e) Collection, management, and retention of personal information and identity\ndocuments; and\n(f) Development and implementation of a comprehensive security plan to ensure\nthe security and integrity of the department's:\n1. Employees;\n2. Facilities;\n3. Storage systems;\n4. Production of operator's licenses, commercial driver's licenses,\ninstruction permits, and personal identification cards; and\n5. Collection and retention of personal information and identity\ndocuments.\n(3) A person who:\n(a) Applies for an initial Kentucky instruction permit, operator's license, or\npersonal identification card under KRS 186.412 or 186.4122, including\nany person who establishes residency in the state, may apply for either a\nvoluntary travel ID or a standard i nstruction permit, operator's license,\nor personal identification card;\n(b) Applies for the renewal of an instruction permit, operator's license, or\npersonal identification card under KRS 186.412, 186.4121, 186.4122, or\n186.4123 may apply for either a volu ntary travel ID or a standard\ninstruction permit, operator's license, or personal identification card;\n(c) 1. Meets the minimum requirements for federal recognition in Section 202\nof the REAL ID ACT of 2005, as amended, in 49 U.S.C. sec. 30301\nnote;\n2. Has been admitted to the United States as a nonimmigrant pursuant to a\ncompact of free association between the United States and the Republic\nof the Marshall Islands, the Republic of Palau, or the Federated States of\nMicronesia; and\n3. Applies for an initial or renewal operator's license or personal\nidentification card under KRS 186.412 or 186.4122;\nmay apply for either a voluntary travel ID or a standard instruction permit,\noperator's license, or personal identification card; and\n(d) Holds a voluntary travel  ID operator's license, and applies for and passes all\nnecessary examinations for a commercial driver's license under KRS Chapter\n281A, shall receive a voluntary travel ID commercial driver's license. This\nparagraph shall not apply to a person who is not a  citizen or permanent\nresident of the United States.\n(4) The fees for initial, renewal, duplicate, or corrected voluntary travel ID or standard\noperator's licenses, instruction permits, or personal identification cards shall be as\nset forth under KRS 186.531.\n(5) A voluntary travel ID identity document issued by the cabinet may be used for all\nstate purposes authorized for identity documents otherwise issued under KRS\n186.400 to 186.640 and Chapter 281A.\n(6) The Transportation Cabinet shall promulgate admin istrative regulations under KRS\nChapter 13A that set standards for the establishment of a voluntary travel ID\nidentity document system, including but not limited to the components of the\nsystem identified in subsection (2) of this section.","path":["KRS Chapter 186"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56600","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:38Z","sha256":"a7b687f86aa5b388cf3f2304ccc5d428dab5916f265fdf446925aa4a5b533c15","source_id":"us-ky","stale":false,"prev":"us-ky/krs-186.402","next":"us-ky/krs-186.405"},"notice":"GroundRules: Original legal text.
