{"data":{"id":"us-ky/krs-186.4102","jurisdiction":"us-ky","citation":"KRS 186.4102","heading":"Photograph required for operator's license, instructional permit, or","body":"personal identification card -- Identification number -- Age and organ donor\ndesignations -- Voluntary travel ID identity document -- When photograph not\nrequired.\n(1) Except a s provided in subsection (9) of this section, the Transportation Cabinet\nshall issue operator's licenses and personal identification cards bearing a photograph\nof the applicant and other information the cabinet may deem appropriate to\nqualified applicants under this chapter. When taking the photograph, the applicant\nshall be prohibited from wearing sunglasses, veils, scarves, or any other attire that\nobscures or creates shadows upon any features of the applicant's face as determined\nby the cabinet. An appli cant shall be required to remove eyewear that obstructs the\niris or the pupil of the eyes and shall not take any action to obstruct a photograph of\nhis or her facial features. The face shall be visible from the crown to the base of the\nchin and from ear to ear. Any person who refuses to remove attire prohibited by this\nsubsection as directed by the person taking the application shall be prohibited from\nreceiving an operator's license or personal identification card.\n(2) An operator's license or personal ide ntification card issued by the cabinet shall not\ncontain the applicant's Social Security number. The cabinet shall promulgate\nadministrative regulations in accordance with KRS Chapter 13A that develop a\nnumbering system that uses an identification system o ther than Social Security\nnumbers. If an applicant submits adequate proof that he or she does not have a\nSocial Security number, the Transportation Cabinet shall assign the applicant a\nunique identifying number.\n(3) The license or personal identification c ard shall also designate by color coding and\nusing the phrase \"under 21\" if the licensee or card holder is under the age of twenty-\none (21); \"CDL\" if the license is issued pursuant to KRS Chapter 281A; or \"under\n21 CDL\" if the licensee holds a commercial d river's license issued pursuant to KRS\nChapter 281A and is under the age of twenty-one (21).\n(4) The cabinet shall provide on each operator's license and personal identification card\nspace for a notation that the holder of the license or personal identific ation card has\nexpressed to the cabinet the person's willingness to make an anatomical gift under\nKRS 311.1917. If a person who has made a declaration under this subsection wishes\nto rescind that declaration, the person shall notify the Kentucky Circuit Co urt\nClerks' Trust for Life, which shall remove the notation from his or her records.\n(5) An operator's license issued pursuant to this chapter shall be designated a Class D\nlicense.\n(6) A person shall not have more than one (1) operator's license.\n(7) Upon marriage, dissolution of marriage, or any other qualifying event, if a person\nseeks to change his or her name, the person shall make a name change with the\nSocial Security Administration prior to applying for an operator's license or a\npersonal identification card and shall provide the cabinet with the person's marriage\nlicense, divorce decree, or other documentation. The name issued on the identity\ndocument shall match the person's first and last name as recorded with the Social\nSecurity Administration. U nless a person is eligible to renew his or her identity\ndocument at the time of the name change, the fee charged under this section shall be\nfor a corrected identity document as set forth in KRS 186.531.\n(8) An identity document issued under this chapter s hall contain a denotation that\neither:\n(a) The identity document is a voluntary travel ID identity document that\ncomplies with the security standards set forth by Pub. L. No. 109 -13, Title II,\nand may be used for identification for federal purposes; or\n(b) The identity document shall not be used for federal identification purposes.\n(9) (a) The Transportation Cabinet may provide for the issuance of an instruction\npermit, operator's license, or personal identification card without a photograph\nif there is goo d cause for the omission based in documented religious\nobjections. The Transportation Cabinet shall promulgate administrative\nregulations pursuant to KRS Chapter 13A to establish the criteria and\nrequirements for obtaining an operator's license, instructio n permit, or\npersonal identification card without a photograph.\n(b) An applicant for an initial instruction permit, operator's license, or personal\nidentification card without a photograph shall apply to the Transportation\nCabinet in Frankfort or a Transpo rtation Cabinet field office. The application\nshall be processed solely by the Transportation Cabinet in the same manner as\nin KRS 186.4121(5) and 186.4123(8).\n(c) An operator's license, instruction permit, or personal identification card issued\nwithout a photograph shall denote on its face that it shall not be accepted by\nany federal agency for identification or any other federal purpose.","path":["KRS Chapter 186"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49850","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:38Z","sha256":"19516e4674f9be3bdf46081f9efc3cccd74dc534960a9255cc78620fdb3fea6d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-186.4101","next":"us-ky/krs-186.411"},"notice":"GroundRules: Original legal text.
