{"data":{"id":"us-ky/krs-186.440","jurisdiction":"us-ky","citation":"KRS 186.440","heading":"Persons ineligible for operator's license -- Reinstatement fee.","body":"An operator's license shall not be granted to:\n(1) Any person who is not a resident of Kentucky;\n(2) Any person under the age of sixteen (16);\n(3) Any person under the age of eighteen (18) who holds a valid Kentucky instruction\npermit issued pursuant to KR S 186.450, but who has not graduated from high\nschool or who is not enrolled and successfully participating in school or who is not\nbeing schooled at home, except those persons who satisfy the District Court of\nappropriate venue pursuant to KRS 159.051(3) that revocation of their license\nwould create an undue hardship. Persons under the age of eighteen (18) shall\npresent proof of complying with the requirements of KRS 159.051;\n(4) Any person whose operator's license has been suspended, during the period of\nsuspension, subject to the limitations of KRS 186.442;\n(5) Any person whose operator's license has been revoked, nor to any nonresident\nwhose privilege of exemption under KRS 186.430 has been refused or discontinued,\nuntil the expiration of the period for which the license was revoked, or for which the\nprivilege was refused or discontinued;\n(6) Any applicant adjudged incompetent by judicial decree;\n(7) Any person who in the opinion of the Department of Kentucky State Police, after\nexamination, is unable to exercise reasonable and ordinary control over a motor\nvehicle upon the highways;\n(8) Any person who is unable to understand highway warnings or direction signs in the\nEnglish language;\n(9) Any person required by KRS 186.480 to take an examination who has n ot\nsuccessfully passed the examination;\n(10) Any person required by KRS Chapter 187 to deposit proof of financial\nresponsibility, who has not deposited that proof;\n(11) Any person who has not filed a correct and complete application attested to in the\npresence of a person authorized to administer oaths;\n(12) Any person who cannot meet the requirements set forth in KRS 186.411(1) or (3);\nor\n(13) Any person whose operator's license has been suspended or revoked under the\nprovisions of KRS Chapter 186, 187, or  189A who has not paid the reinstatement\nfee required under KRS 186.531.","path":["KRS Chapter 186"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49859","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:38Z","sha256":"1d268c8caf75a26579bdb47ad1381dabcb612518bcb96996ded5ac1db80ff9db","source_id":"us-ky","stale":false,"prev":"us-ky/krs-186.435","next":"us-ky/krs-186.442"},"notice":"GroundRules: Original legal text.
