{"data":{"id":"us-ky/krs-186.442","jurisdiction":"us-ky","citation":"KRS 186.442","heading":"Suspension or revocation of license or driving privileges in another","body":"jurisdiction -- Persons eligible for restricted license -- Application and\nsupporting documents -- Issuance of license valid only in Kentucky -- Removal\nof restrictions -- Inapplicability to commercial driver's license.\n(1) The Transportation Cabinet shall, before issuing or renewing a Kentucky operator's\nlicense, verify through the National Drivers Register that the person applying for an\ninitial or renewal Kentucky operator's  license does not currently have his or her\noperator's license or driving privilege suspended or revoked in another licensing\njurisdiction.\n(2) If the person's operator's license or driving privilege is currently suspended or\nrevoked in another licensing j urisdiction for a traffic offense where the conviction\nfor the offense is less than five (5) years old, the Transportation Cabinet shall not\nissue the person an initial or renewal Kentucky operator's license until the person\nresolves the matter in the othe r licensing jurisdiction and complies with the\nprovisions of this chapter.\n(3) A person whose operator's license has been suspended or revoked in another\nlicensing jurisdiction, or the holder of a Kentucky operator's license whose driving\nprivileges have b een suspended in another licensing jurisdiction, may be issued a\nKentucky license, or may renew a Kentucky license if:\n(a) The conviction causing the suspension or revocation is more than five (5)\nyears old;\n(b) The conviction is for a traffic offense othe r than a felony traffic offense or a\nhabitual violator offense; and\n(c) The person has been a resident of the Commonwealth for at least five (5)\nyears prior to the date of application for issuance or renewal.\n(4) (a) A person applying for an operator's license under subsection (3) of this section\nshall submit an application to the cabinet, who shall electronically scan the\napplication and supporting documents, along with a photograph of the\napplicant captured in accordance with KRS 186.4102(1), into the cab inet\ndatabase.\n(b) The cabinet shall review the person's documentation, including the person's\nphotograph, in the cabinet database. If the documentation is verified as\naccurate, and if the person successfully completes any examinations required\nunder KRS 1 86.480 and pays the reinstatement fee required under KRS\n186.531, the cabinet shall present the applicant with a temporary operator's\nlicense, which shall be valid for thirty (30) days, until a permanent operator's\nlicense is mailed to the applicant by the Transportation Cabinet.\n(5) A person issued a Kentucky operator's license in accordance with subsection (3) of\nthis section shall be issued an operator's license marked \"Valid in Kentucky Only\"\nand shall sign a statement that the person understands that h e or she may be subject\nto arrest and detention if stopped by a law enforcement officer in another state while\noperating a motor vehicle on this restricted license.\n(6) If a person granted a license under subsection (3) of this section satisfies the\nrequirements to have the suspension or revocation in another state lifted, the person\nshall apply to the cabinet to be issued a new license without the restrictions outlined\nin subsection (3) of this section.\n(7) The provisions of subsection (3) of this section shall not apply to a commercial\ndriver's license.","path":["KRS Chapter 186"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49860","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:38Z","sha256":"a89f72467fcecbd7176a88c93ff2aea6fe4075eb14f768a3083a4cc1c6154c8d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-186.440","next":"us-ky/krs-186.444"},"notice":"GroundRules: Original legal text.
