{"data":{"id":"us-ky/krs-186.444","jurisdiction":"us-ky","citation":"KRS 186.444","heading":"Medical review board -- Purpose -- Members -- Informal hearing -- Forms","body":"-- Procedures -- Medical report may supersede medical review board --\nAuthority of cabinet to promulgate administrative regulations -- Prohibition\nagainst age-based licensing limitations -- Appeal.\n(1) A medical review board shall be established to receive cases relating to the ability\nof an applicant or holder of a motor vehicle operator's license to drive due to\nphysical or mental disability which may affect or limit a p erson's ability to safely\noperate a motor vehicle.\n(2) The secretary of the Transportation Cabinet shall appoint any number of physicians\nauthorized to practice medicine, osteopaths, optometrists, or advanced practice\nregistered nurses licensed in the Comm onwealth to the medical review board. One\n(1) member who is licensed in the area relevant to the case shall be present in order\nto conduct an informal hearing. The cabinet shall promulgate administrative\nregulations in accordance with KRS Chapter 13A to es tablish the amount each\nmember shall receive per day for attending meetings of the board, and each member\nshall be reimbursed for necessary expenses incurred in attending meetings. The\nboard shall use reasonable efforts to minimize the costs to the person whose case is\nunder review.\n(3) The cabinet shall promulgate administrative regulations in accordance with KRS\nChapter 13A to establish the medical review board forms, which shall include a\nsigned sworn statement affirming that the person has a physical or  mental condition\nthat could impair his or her ability to operate a motor vehicle, the medical standards\nfor operators of motor vehicles, and the procedures of the medical review board in\nconducting informal hearings.\n(4) A person who is under review pursuant to a medical review board case shall, upon a\nrequest in writing, be furnished with a copy of the report alleging that the person\nhas a physical or mental condition that could impair his or her ability to operate a\nmotor vehicle.\n(5) If the cabinet decides to take action to restrict a person's driving privileges, it shall:\n(a) Provide written notice to the person of the decision to take licensing action;\nand\n(b) Inform the person that the licensing action shall take place unless the person\nsubmits to and  completes an examination in satisfaction of the medical\nstandards set forth in administrative regulation.\n(6) If the person is unable to satisfactorily complete the examination under subsection\n(5)(b) of this section, the cabinet shall, prior to the deci sion to take licensing action\nbased on a person's physical or mental condition, consult with appointed members\nof the medical review board who are licensed in the area relevant to the case.\n(7) If the cabinet takes action to restrict a person's driving pri vileges, the person may\nrequest an informal hearing in front of the medical review board.\n(8) At any time during the proceeding of a case, a properly submitted report in response\nto the medical review board from a person's licensed medical professional\ncertifying that, based on the application of the medical review board standards set\nforth in administrative regulation and the vision standards for vision specialists set\nforth in KRS 186.577, the person does not have a condition that impairs his or her\nability to operate a motor vehicle, may supersede the medical review board and the\nperson may be approved to operate a motor vehicle unless other physical or mental\nconditions exist.\n(9) The cabinet shall not promulgate administrative regulations for the purpose of\ncreating tests or other criteria that might limit a person's ability to obtain or retain\nan operator's license because that person may be considered too old to drive.\n(10) Any p erson aggrieved by a decision made as a result of an informal hearing\nconducted under authority of KRS 186.411 and this section may appeal, and upon\nappeal an administrative hearing shall be conducted in accordance with KRS\nChapter 13B.","path":["KRS Chapter 186"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56229","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:38Z","sha256":"25c1d772b032b7c7f32cf4fec1617d07ebe1c340fbf2617a5e096762e77ae1e0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-186.442","next":"us-ky/krs-186.445"},"notice":"GroundRules: Original legal text.
