{"data":{"id":"us-ky/krs-186.579","jurisdiction":"us-ky","citation":"KRS 186.579","heading":"Restricted operator's license requiring daytime driving, use of bioptic","body":"telescopic device, and vehicle with left and right outside mirrors -- Removal of\nrestrictions -- Annual submission of comprehensive visual examination --\nSuspension of license.\n(1) The Transportation Cabinet shall issue, to an applicant who successfully passes the\noperator's license examination outlined in KRS 186.578(4), an operator's license\nwith the following restrictions:\n(a) Required use of a bioptic telescopic device;\n(b) Restricted to daytime driving upon the recommendation of a vision specialist\nor upon failure of a nighttime examination administered under KRS 186.578;\nand\n(c) Restricted to vehicles with left and right outside mirrors.\n(2) A restriction to daytime  driving in accordance with subsection (1) of this section\nshall be removed if the applicant or licensed driver:\n(a) Obtains a recommendation from a vision specialist;\n(b) Successfully completes an evaluation by the Office of Vocational\nRehabilitation's bioptic driving program and training specifically designed for\nnight driving from a certified driver training program; and\n(c) Passes a comprehensive night driving examination.\n(3) (a) Subject to the requirements of paragraph (b) of this subsection, an opera tor's\nlicense issued under KRS 186.578 and 186.579 shall be valid for four (4)\nyears or (8) years at the discretion of the applicant as outlined in KRS\n186.4101.\n(b) The holder of a license issued in accordance with this section and KRS\n186.578 shall submi t the results of a comprehensive visual examination to\nKentucky Office of Vocational Rehabilitation each year before the last day of\nthe birth month of the license holder. An operator's license shall be subject to\nsuspension if the license holder does not submit results of the comprehensive\nvisual examination required under this paragraph.\n(c) If the vision specialist completing the examination required under paragraph\n(b) of this subsection certifies that the conditions causing the visual\nimpairment are st able, then the license shall remain valid. If the conditions\ncausing the visual impairment are unstable or deteriorating, the license holder\nmay be required to undergo additional testing as required by the department\nand may have his or her operator's lice nse suspended if he or she cannot\nsuccessfully pass the tests.","path":["KRS Chapter 186"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52800","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:38Z","sha256":"cd3bcf62808bbe3bfeeba67a5b34ea5acdc1587c12e7118410da79e6a31bb51d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-186.578","next":"us-ky/krs-186.580"},"notice":"GroundRules: Original legal text.
