{"data":{"id":"us-ky/krs-186.763","jurisdiction":"us-ky","citation":"KRS 186.763","heading":"Use of fully autonomous vehicle permissible -- Conditions -- Law","body":"enforcement interaction plan.\n(1) Subject to the limitations in subsection (2) of this section, a person may operate a\nfully autonomous vehicle on the highways of this state wit hout a human driver\nprovided that the automated driving system is engaged and the vehicle meets the\nfollowing conditions:\n(a) If a failure of the automated driving system occurs that renders that system\nunable to perform the entire dynamic driving task rel evant to its intended\noperational design domain, the fully autonomous vehicle will achieve a\nminimal risk condition;\n(b) The fully autonomous vehicle is capable of operating in compliance with the\napplicable traffic and motor vehicle safety laws and regula tions of this state\nwhen reasonable to do so, unless an exemption has been granted by the\nTransportation Cabinet; and\n(c) When required by federal law, the vehicle bears the required manufacturer's\ncertification label indicating that at the time of its man ufacture it has been\ncertified to be in compliance with all applicable federal motor vehicle safety\nstandards, including any exemptions granted by the National Highway Traffic\nSafety Administration.\n(2) From July 15, 2024, until July 31, 2026, a fully auto nomous vehicle for which the\ndeclared gross weight of the vehicle and any towed unit is more than sixty -two\nthousand (62,000) pounds shall have a human driver, with the appropriate\ncredentials to operate the vehicle, present in the vehicle to monitor the p erformance\nof the vehicle and intervene if necessary.\n(3) Prior to operating a fully autonomous vehicle on the highways of this state without\na human driver, a person shall submit a law enforcement interaction plan to the\nTransportation Cabinet and the Department of Kentucky State Police that describes:\n(a) How to communicate with a fleet support specialist who is available during\nthe times the vehicle is in operation;\n(b) How to safely remove the fully autonomous vehicle from the roadway and\nsteps to safely tow the vehicle;\n(c) How to recognize whether the automated driving system is engaged on the\nfully autonomous vehicle; and\n(d) Any additional information the manufacturer or owner deems necessary\nregarding hazardous conditions or public safety risks asso ciated with the\noperation of the fully autonomous vehicle.","path":["KRS Chapter 186"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55488","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:39Z","sha256":"ef3910c743d6cb5c0be43bddda46fb55303efb70be51b17d5fa928a28258eabd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-186.760","next":"us-ky/krs-186.766"},"notice":"GroundRules: Original legal text.
