{"data":{"id":"us-ky/krs-186a.147","jurisdiction":"us-ky","citation":"KRS 186A.147","heading":"Prohibition against registration of personal motor vehicle owned by","body":"delinquent taxpayer -- Written tax clearance -- Informal hearing -- Exception.\n(1) A county clerk shall not process an application for, nor issue a:\n(a) Kentucky registration or renewal of registration;\n(b) Replacement plate, decal, or registration certificate;\n(c) Duplicate registration;\n(d) Transfer of registration; or\n(e) Temporary tag;\nfor any motor vehicle if AVIS lists the vehicle identification number of the motor\nvehicle as owned by a delinquent taxpayer as defined in KRS 131.1817.\n(2) The county clerk shall not process the applicable application or issue the applicable\ndocument until a written tax clearance has been received by the Department of\nVehicle Regulation from the Finance and Administration Cabinet, Department of\nRevenue, as provided in KRS 131.1817.\n(3) (a) A person who has been adversely affected by the refusal of a county clerk to\nprocess an application or issue a document under this section may request an\ninformal hearing, to be conducted by the Transportation Cabinet or its agency\ndesignated in writing for that purpose.\n(b) The request for the informal hearing shall be writing and shall be filed with\nthe Transportation Cabinet within thirty (30) days after the c ounty clerk's\nrefusal to process an application or issue a document.\n(c) The only matter to be considered at the hearing shall be whether there is a\nmistake in fact made by the Department of Revenue or the Department of\nVehicle Regulation in the determinat ion that the person is a delinquent\ntaxpayer.\n(4) This section shall not apply to any transactions involving Kentucky motor vehicle\ndealers who are licensed under KRS 190.030.","path":["KRS Chapter 186A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42620","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:40Z","sha256":"1a866b3e41b78d9ee26739b245828ffe13c13a09151a750eef2ca7072e8a7e84","source_id":"us-ky","stale":false,"prev":"us-ky/krs-186a.145","next":"us-ky/krs-186a.150"},"notice":"GroundRules: Original legal text.
