{"data":{"id":"us-ky/krs-186a.170","jurisdiction":"us-ky","citation":"KRS 186A.170","heading":"Duties of Department of Vehicle Regulation in processing title","body":"applications.\n(1) The Department of Vehicle Regulation shall:\n(a) Within five (5) working days following receipt by it of an application for a\ncertificate of title in proper form, process the application and its supporting\ndocuments in the manner provided in this section, and unless it finds\ndiscrepancies with respect to it or its supporting documents, issue a certificate\nof title in the name of the owner and send it postpaid to such owner;\n(b) Within forty -eight (48) hours following electronic notification by a county\nclerk's office of an application for a certificate of title, issue a speed title\nwhich shall be held for pickup or returned to the owner by mail. The clerk\nshall take the application for title and process the appropriate paperwork as\nprovided for in this chapter. Subject to the limitations outlined in paragraph\n(c) of this subsection, the department may provide by administrative\nregulation for exceptions to the speed title procedure; and\n(c) Not exempt vehicles with salvage and rebuilt titles from the speed title\nprocedures, but may extend the processing time on salvage and rebuilt title\napplications for which the documentation is complete and accurate for up to:\n1. Fifteen (15) business days for rebuilt vehicles that have been branded as\nunrebuildable in another state under KRS 186A.530(5) and (6); and\n2. Five (5) business days for all other salvage and rebuilt vehicles.\n(2) Upon receiving an application packet fro m a county clerk, the Department of\nVehicle Regulation title examiner shall verify that the application form and its\nsupporting documents are complete.\n(3) In the event there is a discrepancy between the application form and the supporting\ndocuments, the Department of Vehicle Regulation shall stop the application process\nand promptly contact the issuing clerk to resolve the discrepancy. After resolving\nthe discrepancy, the clerk shall resubmit the application for further review and\napproval.\n(4) The Department of Vehicle Regulation shall carry out the following action with\nrespect to each application:\n(a) Examine the owner's application for legibility and proper execution, presence\nof required information, including required supporting documents, and the\npresence of required signatures. The Department of Vehicle Regulation shall\nensure also that the required supporting documents are consistent in pertinent\npart with the information shown on the owner's application;\n(b) The documents supporting an o wner's application shall be examined as to\nauthenticity and to determine if fraudulent alteration has occurred;\n(c) Ensure that the vehicle identification number of the subject vehicle is\napparently legitimate;\n(d) Ensure that the vehicle identification nu mber and any other appropriate\ninformation with respect to a vehicle for which a certificate of title has been\napplied for is compared against the National Crime Information Center\n(NCIC) computerized listings of vehicles reported stolen, unless NCIC is no t\noperational and the department has official notification that it is not expected\nto be operational within four (4) working days following the day on which an\napplication for a certificate of title is received by it; and\n(e) Compare the computer -produced certificate of title for consistency with the\nowner's application and supporting documents.\n(5) The title application examiner shall ensure that each application has received the\nrequired examinations as indicated by the presence of each required approval via\nthe application. Upon satisfying himself or herself that an application has passed the\nrequired examinations, the title examination certifier shall place his or her approval\nin KAVIS together with the date upon the application.\n(6) The Department of Ve hicle Regulation shall withhold issuance of a title, until its\nquestions are resolved to its satisfaction, when it finds material discrepancies or has\ninformation giving probable cause to believe:\n(a) That an applicant is not the lawful owner of a vehicle for which he or she\nseeks a title;\n(b) His or her application is not in order;\n(c) The documentation supporting an application is insufficient or fraudulent;\n(d) The vehicle has an illegitimate vehicle identification number;\n(e) The vehicle is stolen; or\n(f) That the computer -produced certificate of title is not consistent with the\nowner's application.\n(7) In the case of multiple owners, the Department of Vehicle Regulation shall require\nonly two (2) primary owners' names to be printed on the certificate of  title. Upon\nsubmission of the title application, if more than two (2) owners are listed, the\nprimary owners shall be determined by the title applicants. In such instances, the\ncertificate of the title shall note that there are more than two (2) owners. Th e names\nof all title applicants shall be documented in AVIS.\n(8) When the Department of Vehicle Regulation finds that a certificate of title should\nbe issued for a vehicle, the endorsement of the commissioner of the Department of\nVehicle Regulation shall b e engrossed upon the certificate of title following a\npreprinted statement which shall read: I certify that the Department of Vehicle\nRegulation has exercised due diligence in examining an application for a certificate\nof title for the above-described vehicle, and to the best of our knowledge and belief,\nthe applicant whose name appears above is the lawful owner of the apparently\nlegitimate vehicle described herein. --------------- (signature), commissioner,\nDepartment of Vehicle Regulation, Kentucky Transportation Cabinet.","path":["KRS Chapter 186A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56320","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:40Z","sha256":"21af2bb2816bb4aa75148109b3ead39281bb1fb1971fc84515f6c9777cfe7543","source_id":"us-ky","stale":false,"prev":"us-ky/krs-186a.165","next":"us-ky/krs-186a.175"},"notice":"GroundRules: Original legal text.
