{"data":{"id":"us-ky/krs-186a.295","jurisdiction":"us-ky","citation":"KRS 186A.295","heading":"Owner to surrender title on destroyed vehicle or trailer -- Salvage title","body":"exception.\n(1) (a) Subject to the limitations in paragraph (c) of this subsection, any person or\nentity having a motor vehicle or trailer that has been destroyed, to t he extent\nthat its repair cannot be obtained through usual commercial repair services, at\na cost less than its retail value as prescribed by a nationally accepted used car\nvaluation guide or tool identified under KRS 304.20 -110, or from which two\n(2) or more parts which typically bear a vehicle identification number placed\nthereon by the manufacturer have been removed, or which he or she removes,\nshall surrender the certificate of title for the vehicle for which he or she has a\ncertificate of title in his, or her, or another name, to the county clerk of the\ncounty in which the vehicle is located. The clerk shall immediately forward\nthe surrendered title to Frankfort with instructions for canceling the title.\n(b) Any person or entity engaged in the sale of us ed motor vehicle or trailer parts,\nor the recycling or salvage of them, shall surrender the certificate of title for\nany vehicle in his or her possession, and for which he or she has a certificate\nof title, whether in his or her or another name, if the veh icle is destroyed\nwithin the meaning of paragraph (a) of this subsection, or from which two (2)\nor more parts which typically bear a vehicle identification number placed\nthereon by a manufacturer have been removed, or which he or she removes, to\nthe county clerk of the county in which the vehicle is located. The clerk shall\nimmediately forward the surrendered title to Frankfort with instructions for\ncanceling the title.\n(c) 1. The calculation of the cost of repair referenced in paragraph (a) of this\nsubsection shall only include labor and parts for actual damage to the\nsuspension, motor, transmission, frame or unibody, and designated\nstructural components, and shall not include cosmetic damages.\n2. Subparagraph 1. of this paragraph shall not alter the calcul ation of the\ncost of repair for any existing obligation of an insurer to pay for the cost\nof parts and labor for cosmetic repairs to a motor vehicle or trailer that\naffects the vehicle's appearance in accordance with KRS 186A.520.\n(d) The surrender of the certificate of title pursuant to this section shall be made\nwithin ten (10) working days, next succeeding the day when the vehicle was\nreceived, destroyed, or next succeeding the day during which a second part\nwas removed.\n(2) Each county clerk shall recei ve without charge, a certificate surrendered in\naccordance with this section, cancel it, and remit it to the Department of Vehicle\nRegulation, and take any other action related to it, as required by the Department of\nVehicle Regulation.\n(3) If the calculation of the cost of repair in subsection (1) of this section exempts a\nvehicle from having the certificate of title surrendered, the title shall be branded as\na salvage title in accordance with KRS 186A.520.","path":["KRS Chapter 186A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57591","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:40Z","sha256":"9918e64eb9abc1ae607aa4e70284c543d8939dc63775b075a8588665deffd31d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-186a.290","next":"us-ky/krs-186a.297"},"notice":"GroundRules: Original legal text.
