{"data":{"id":"us-ky/krs-186a.297","jurisdiction":"us-ky","citation":"KRS 186A.297","heading":"Filing of affidavit of conversion to real estate when manufactured home","body":"is permanently affixed to land -- Requirements for surrender of certificate of\ntitle.\n(1) When a manufactured home is or is to be permanently affixed to real estate, the\nowner may execute and file an affidavit of conversion to real estate with the county\nclerk of the county in which the real estate is located. The affidavit shall attest to the\nfact that the home has been or will be permanently affixed to the real estate a nd be\naccompanied by a surrender of the Kentucky certificate of title. The county clerk\nshall file the affidavit of conversion to real estate in the miscellaneous record book.\n(2) A county clerk shall not accept a surrender of a Kentucky certificate of tit le which\ndisplays an unreleased lien unless it is accompanied by:\n(a) A release of the lien; or\n(b) An affidavit, signed under oath by the attorney who satisfied the liens noted\non the Kentucky certificate of title, attesting that all liens noted on the\nKentucky certificate of title have been paid. An affidavit filed by an attorney\nunder this paragraph may only be signed by an attorney licensed to practice\nlaw in the Commonwealth.\n(3) The provisions of subsection (2) of this section shall not excuse a lender who placed\na lien on the certificate of title from filing a release of the lien.\n(4) Upon receipt of the information identified in subsection (2) of this section, the\ncounty clerk shall accept the affidavit of conversion and the surrender of the\nKentucky certificate of title.\n(5) In the event of an inaccurate or fraudulent affidavit, the title surrender becomes null\nand void.\n(6) The county clerk shall be held harmless if he or she relies upon receipt of the\ninformation identified in subsection (2) of this section.\n(7) When the county clerk files the affidavit of conversion to real estate, the county\nclerk shall furnish a copy to the property valuation administrator for inclusion in the\nreal property tax rolls of the county. A filing of an affidavit of con version to real\nestate and a surrender of a Kentucky certificate of title shall be deemed a conversion\nof the property as an improvement to the real estate upon which it is located.","path":["KRS Chapter 186A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52793","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:40Z","sha256":"08b09d57261197742eb3113d139f97719886e599d51f0542d573963a50e64e8d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-186a.295","next":"us-ky/krs-186a.298"},"notice":"GroundRules: Original legal text.
