{"data":{"id":"us-ky/krs-189.212","jurisdiction":"us-ky","citation":"KRS 189.212","heading":"Authority of fiscal court to issue special permits for certain haulers.","body":"(1) As used in this section, \"materials\" shall mean cargo, whether divisible or\nnondivisible, that a motor vehicle transports in the usual and ordinary course of\nbusiness and shall specifically include, but not be limited to, agricultural products,\nminerals, or natural resources transported by a motor vehicle.\n(2) A fiscal court may issue special permits to the owners, operators, or lessees of\nmotor vehicles for the purpose of hauling materials whose gross weight or\ndimensions, including vehicle and load, exce eds the limits prescribed by KRS\n189.210 but that do not exceed the maximum weight limits established in KRS\n189.222. A permit shall be issued for specified materials only and shall designate\nthe portions of the fiscal court -owned road over which the vehic le may operate\nunder the permit. The permit shall be issued for a stated period of time not to\nexceed one (1) year and shall be upon the terms and conditions as the fiscal court\nmay, in its discretion, require. The fiscal court shall require, as a conditio n to\nissuing the permit, that the applicant pay a reasonable fee to be fixed by the fiscal\ncourt and enter into a cooperative agreement under the provisions of KRS 189.230.\nThe operation of any motor vehicle in accordance with the terms of the permit shall\nnot constitute a violation of this chapter, if the operator has a valid permit, or a copy\nof a valid permit, in his or her possession.\n(3) The fiscal court shall not issue a permit under this section for a vehicle whose\ndimensions, including vehicle and l oad, exceed the maximum dimension limits\nestablished in KRS 189.222.\n(4) A person shall not operate a motor vehicle in violation of the terms and conditions\nof any permit issued by the fiscal court under this section.\n(5) A fiscal court may:\n(a) Exercise general supervision for administering and enforcing the provisions of\nthis section.\n(b) Adopt ordinances regulating the issuance of a permit, including but not\nlimited to matters concerning the duration of permits and weight limits for\nvarious types of vehicles, materials, and highways.\n(c) Adopt rules and regulations governing the amount, terms, and conditions of a\nbond and the sufficiency of the surety of any bond required by this section.\n(d) Issue, continue in effect, revoke, modify, or deny a permit iss ued under this\nsection.","path":["KRS Chapter 189"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=6323","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:42Z","sha256":"f7fa66e9441ec7a33d03e8186b65f1ac0c4c10fb4e379aa187733263eea5f8bf","source_id":"us-ky","stale":false,"prev":"us-ky/krs-189.210","next":"us-ky/krs-189.214"},"notice":"GroundRules: Original legal text.
