{"data":{"id":"us-ky/krs-189.2326","jurisdiction":"us-ky","citation":"KRS 189.2326","heading":"Automated speed enforcement devices in highway work zone --","body":"Definitions -- Procedures -- Administrative regulations.\n(1) As used in this section:\n(a) \"Automated speed enforcement device\" means a photographic, radar, lidar,\nlaser, or other de vice with one (1) or more vehicle sensors that transmits a\nvehicle's speed and an image of the rear license plate of a vehicle exceeding\nthe speed limit; and\n(b) \"Images\" means images transmitted by an automated speed enforcement\ndevice showing the speed and rear license plate of a motor vehicle.\n(2) A peace officer may issue a citation at the time of an offense in a highway work\nzone based on images transmitted by an automated speed enforcement device if:\n(a) A motor vehicle is detected traveling in excess of ten (10) miles per hour over\nthe posted speed limit;\n(b) At least one (1) bona fide worker is present in the highway work zone; and\n(c) There is a peace officer certified under KRS 15.380 to 15.404 present in or\nnear the end of the highway work zone in a marked vehicle.\n(3) The cabinet shall:\n(a) 1. Install signage in highway work zones notifying the public that vehicle\nspeed within the work zone may be enforced by an automated speed\nenforcement device; and\n2. Require the signage to be affixed with lights that shall be flashing at all\ntimes when the automated speed enforcement device is active; and\n(b) Calibrate the automated speed enforcement device on an annual basis.\n(4) An image transmitted by an automated s peed enforcement device under this section\nshall not be disclosed to anyone other than the driver of the vehicle.\n(5) The cabinet shall promulgate administrative regulations in accordance with KRS\nChapter 13A relating to any matters necessary for the effic ient administration of\nautomated speed enforcement under this section.","path":["KRS Chapter 189"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56550","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:42Z","sha256":"c15d8f76d42a7cfe16480bd11b28fb0e1b239fa5a6be83f6b299423f55c4506d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-189.2325","next":"us-ky/krs-189.2327"},"notice":"GroundRules: Original legal text.
