{"data":{"id":"us-ky/krs-189.370","jurisdiction":"us-ky","citation":"KRS 189.370","heading":"Passing stopped school or church bus prohibited -- Application to properly","body":"marked vehicles -- Rebuttable presumption as to identity of violator.\n(1) If any school or church bus used in the transportation of children is stopped upon a\nhighway for the purpose of receiving or discharging passengers, with the stop arm\nand signal lights activated, the operator of a vehicle approaching from any direction\nshall bring the vehicle to a stop and shall not proceed until the bus has completed\nreceiving or  discharging passengers and has been put into motion. The stop\nrequirement provided for in this section shall not apply to vehicles approaching a\nstopped bus from the opposite direction upon a highway of four (4) or more lanes\ndivided by an elevated barrier or unpaved median.\n(2) This section shall be applicable only when the bus displays the markings and\nequipment required by Kentucky minimum specifications for school buses.\n(3) If any vehicle is witnessed to be in violation of this section and the identit y of the\noperator is not otherwise apparent, it shall be a rebuttable presumption that the\nperson in whose name the vehicle is registered or leased was the operator of the\nvehicle at the time of the alleged violation and is subject to the penalties as\nprovided for in KRS 189.990(5).","path":["KRS Chapter 189"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57416","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:42Z","sha256":"ed9a641a1f4ae2545a43cf4dbe1e77b1a05cb73d1045f0965b53c86436a899d3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-189.360","next":"us-ky/krs-189.375"},"notice":"GroundRules: Original legal text.
