{"data":{"id":"us-ky/krs-189.503","jurisdiction":"us-ky","citation":"KRS 189.503","heading":"Racing events within local government jurisdiction -- Permits -- Charges --","body":"Applicants -- Notice -- Exemption from standards.\n(1) As used in this section:\n(a) \"County roads\" has the same meaning as in KRS 178.010(1)(b);\n(b) \"Local governm ent\" means any city, county, urban -county government,\nconsolidated local government, charter county government, or unified local\ngovernment of the Commonwealth;\n(c) \"Participant\" means any person who drives or maintains a motor vehicle used\nin a racing event;\n(d) \"Racing event\" means a motor vehicle race which is sanctioned by a\nnationally or internationally recognized racing organization and includes\npreparations, practices, and qualifications for the race; and\n(e) \"Streets\" has the same meaning as in KRS 177.365(4).\n(2) A local government may provide permits to allow a racing event within its\njurisdiction:\n(a) On county roads;\n(b) On streets;\n(c) On state -maintained highways in accordance with subsection (7) of this\nsection; or\n(d) At airports, subject to approval from the relevant airport board.\n(3) A local government may charge an applicant for a permit under this section:\n(a) An application fee not to exceed one thousand dollars ($1,000); and\n(b) The cost of any expenses incurred by the local government to facilitate the\nracing event.\n(4) A local government that issues a permit for a racing event shall ensure the applicant\nfor the permit has:\n(a) Adequate insurance to pay any damages incurred because of loss or injury to\nany person or property;\n(b) Adequate security, emergency services, and necessary facilities provided\nduring the racing event; and\n(c) The ability to protect the health, safety, and welfare of the citizens of the local\ngovernment, the race participants, and those attending the racing event.\n(5) For the facilitation of a racing event sanctioned under this section, a local\ngovernment may:\n(a) Temporarily close roads, streets, highways, alleys, sidewalks, and airport\nrunways;\n(b) Reroute pedestrian and motor vehicle traffic; and\n(c) Waive local ordinances and traffic regulations.\n(6) No less than sixty (60) days prior to a scheduled racing event, a local government\nshall provide written notice to the Transportation Cabinet of any racing event\npermit issued under this section. The written notice shall include:\n(a) The time, date, and location of the racing event;\n(b) The nationally or internationally recognized racing organization sponsoring\nthe event;\n(c) A road closure plan that specifies the streets, roads, highways, all eys,\nsidewalks, and airport runways that will be temporarily closed or obstructed\nduring the racing event;\n(d) A traffic control plan that specifies the on -site traffic controls and detour\nroutes to be used during the racing event;\n(e) The names and phone  numbers of emergency and law enforcement contacts\noverseeing the racing event; and\n(f) If applicable, a request to cross or use a portion of a state -maintained highway\nas part of the route in accordance with subsection (7) of this section.\n(7) The route o f a racing event under this section that uses or crosses any state -\nmaintained highway shall be subject to prior approval by the Transportation\nCabinet.\n(8) So long as the participants adhere to all requirements and regulations set forth by\nthe nationally o r internationally recognized racing organization sponsoring the\nracing event, participants in a racing event under this section shall be exempt from\nall vehicle equipment and operation standards of this chapter.","path":["KRS Chapter 189"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54960","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:43Z","sha256":"7d1a1f2e6148d6ef7181f0d1b694d1fff892610a69b8ce9c5cff0a392599b56f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-189.500","next":"us-ky/krs-189.505"},"notice":"GroundRules: Original legal text.
