{"data":{"id":"us-ky/krs-189.572","jurisdiction":"us-ky","citation":"KRS 189.572","heading":"Definitions for section -- Prohibitions for pedestrians -- Exceptions -- Local","body":"ordinances -- Administrative regulations.\n(1) As used in this section:\n(a) \"Local government\" means any city, county, consolidated local government,\nurban-county g overnment, charter county government, or unified local\ngovernment; and\n(b) \"State-maintained right -of-way\" means any land, property, or infrastructure\nunder the jurisdiction or maintenance of the Kentucky Transportation Cabinet\nthat is used by the public for transportation purposes, including but not limited\nto travel lanes, paved and unpaved shoulders, medians, entrance and exit\nramps, and adjacent grassy or drainage areas not designated for pedestrian\nuse.\n(2) Except as provided in subsection (3) or (4) o f this section, a person shall not sit,\nkneel, recline, stand, or remain physically stationary in any portion of a state -\nmaintained right-of-way that is not designated for pedestrian use.\n(3) Subsection (2) of this section shall not apply to:\n(a) Individuals experiencing a medical emergency;\n(b) Individuals involved in a vehicle -related emergency, provided they remain in\nthe immediate area of the vehicle;\n(c) Emergency personnel or public utility workers performing their official\nduties; or\n(d) Persons loca ted within a pedestrian -designated area such as a sidewalk,\nmarked crosswalk, or transit stop.\n(4) A local government may by ordinance authorize limited exceptions to subsection\n(2) of this section if:\n(a) The ordinance:\n1. Establishes a clear process by which a person may request and receive\nauthorization by the local government to act in accordance with any\nadopted exception;\n2. Applies uniformly; and\n3. Is based solely on objective criteria that is ministerially applied;\n(b) Authorization granted by the local government to any person is limited in\nduration and scope;\n(c) The local government maintains records of each authorization provided under\nthis subsection that includes a statement of justification for its issuance; and\n(d) Any ordinance adopted under this subsection, and any authorization granted\npursuant thereto, comply with this section and any administrative regulations\npromulgated by the Transportation Cabinet.\n(5) The Transportation Cabinet may promulgate administ rative regulations in\naccordance with KRS Chapter 13A to define minimum pedestrian safety standards\nfor state-maintained rights-of-way.","path":["KRS Chapter 189"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57272","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:43Z","sha256":"03be2f75feeb0c30b38b312c76b71a016e7a056e7c7a703865202e96fbc1b50e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-189.570","next":"us-ky/krs-189.575"},"notice":"GroundRules: Original legal text.
