{"data":{"id":"us-ky/krs-189.753","jurisdiction":"us-ky","citation":"KRS 189.753","heading":"Abandonment of motor vehicle on state highway -- Presumption --","body":"Notification -- Removal.\n(1) Any motor vehicle left upon the right -of-way of a state highway for three (3)\nconsecutive days shall be presumed an abandoned vehicle.\n(2) The Department of K entucky State Police shall locate abandoned vehicles on the\nright-of-way of state highways. Upon determination that a vehicle is abandoned, and\nnotwithstanding the provisions of KRS 189.450, the Department of Kentucky State\nPolice may order any person enga ged in the business of storing or towing motor\nvehicles to remove the abandoned vehicle to a site chosen by the person. The\ndepartment shall determine, if possible, the ownership of the vehicle through the\nabandoned vehicle's license plates, serial number,  or other methods of determining\nownership. As soon as practicable, the owner shall be notified by mail, whether he\nor she is a Kentucky resident or a resident of another state, that the abandoned\nvehicle was illegally upon public property; the name and th e address where the\nstorage facility is located; that removal of the vehicle from the storage facility will\ninvolve payment of towing and storage charges; and that the vehicle may be sold\npursuant to provisions of KRS 376.275 if not claimed within sixty (6 0) days. A\nnotification shall not be required if ownership cannot be determined. In the event of\nsuch sale, the state shall receive any proceeds after the satisfaction of all liens\nplaced on the vehicle.\n(3) The commissioner of the Department of Kentucky S tate Police shall promulgate\nadministrative regulations pursuant to KRS Chapter 13A to carry out the provisions\nof this section.","path":["KRS Chapter 189"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=6451","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:43Z","sha256":"1f0b8ae0ca3ddebbef78a098887abf09f4e2a6a76114814745a3a71a2366e152","source_id":"us-ky","stale":false,"prev":"us-ky/krs-189.752","next":"us-ky/krs-189.754"},"notice":"GroundRules: Original legal text.
