{"data":{"id":"us-ky/krs-189a.050","jurisdiction":"us-ky","citation":"KRS 189A.050","heading":"Service fee -- Amount -- Payment -- Remedies for nonpayment -- Use of","body":"revenue from fees collected.\n(1) All persons convicted of violation of KRS 189A.010(1)(a), (b), (c), (d), or (e) shall\nbe sentenced to pay a service fee of four hundred twenty -five dollars ($425), which\nshall be in addition to all other penalties authorized by law.\n(2) The fee shall be imposed in all cases but shall be subject to the provisions of KRS\n534.020 and KRS 534.060.\n(3) The first fifty dollars ($50) of each service fe e imposed by this section shall be paid\ninto the general fund, the second fifty dollars ($50) of each service fee imposed by\nthis section shall be paid to the ignition interlock administration fund established in\nKRS 189A.380, and the remainder of the reve nue collected from the service fee\nimposed by this section shall be utilized as follows:\n(a) Twelve percent (12%) shall be transferred to the Department of Kentucky\nState Police forensic laboratory for the acquisition, maintenance, testing, and\ncalibration of alcohol concentration testing instruments and the training of\nlaboratory personnel to perform these tasks;\n(b) Twenty percent (20%) shall be allocated to the Department of Public\nAdvocacy;\n(c) One percent (1%) shall be transferred to the Prosecutors Ad visory Council for\ntraining of prosecutors for the prosecution of persons charged with violations\nof this chapter and for obtaining expert witnesses in cases involving the\nprosecution of persons charged with violations of this chapter or any other\noffense in which driving under the influence is a factor in the commission of\nthe offense charged;\n(d) Sixteen percent (16%) shall be transferred as follows:\n1. Fifty percent (50%) shall be credited to the traumatic brain injury trust\nfund established under KRS 211.476; and\n2. Fifty percent (50%) shall be credited to the Cabinet for Health and\nFamily Services, Department for Behavioral Health, Developmental and\nIntellectual Disabilities, for the purposes of providing direct services to\nindividuals with brain injuries that may in clude long -term supportive\nservices and training and consultation to professionals working with\nindividuals with brain injuries. As funding becomes available under this\nsubparagraph, the cabinet may promulgate administrative regulations\npursuant to KRS Cha pter 13A to implement the services permitted by\nthis subparagraph;\n(e) Any amount specified by a specific statute shall be transferred as provided in\nthat statute;\n(f) Forty-six percent (46%) shall be transferred to be utilized to fund enforcement\nof this chapter and for the support of jails, recordkeeping, treatment, and\neducational programs authorized by this chapter and by the Department of\nPublic Advocacy; and\n(g) The remainder shall be transferred to the general fund.\n(4) The amounts specified in subse ction (3)(a), (b), (c), and (d) of this section shall be\nplaced in trust and agency accounts that shall not lapse.","path":["KRS Chapter 189A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54545","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:44Z","sha256":"1f2d5244dd1e6a85a6ec22aa60333a67c77360086ef73927651a5446225b5af2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-189a.045","next":"us-ky/krs-189a.060"},"notice":"GroundRules: Original legal text.
