{"data":{"id":"us-ky/krs-189a.090","jurisdiction":"us-ky","citation":"KRS 189A.090","heading":"Operating motor vehicle while license is suspended for driving under the","body":"influence prohibited -- Operating motor vehicle without ignition interlock\nlicense or hardship license prohibited -- Penalties.\n(1) No person shall operate or be in phy sical control of a motor vehicle or motorcycle\nwhile his or her license is suspended under this chapter, unless the person has a\nvalid:\n(a) Ignition interlock license in the person's possession and:\n1. The motor vehicle or motorcycle is equipped with a fun ctioning ignition\ninterlock device; or\n2. The person is operating or in physical control of an employer's motor\nvehicle or motorcycle in accordance with KRS 189A.340(6); or\n(b) Hardship license in the person's possession.\n(2) In addition to the period of l icense suspension imposed by KRS 189A.070, any\nperson who violates subsection (1) of this section shall:\n(a) For a first offense within a ten (10) year period, be guilty of a Class B\nmisdemeanor and have his or her license suspended by the Transportation\nCabinet for six (6) months, unless at the time of the offense the person was\nalso operating or in physical control of a motor vehicle in violation of KRS\n189A.010(1)(a), (b), (c), (d), or (e), in which event the person shall be guilty\nof a Class A misdemean or and have his or her license suspended by the\nTransportation Cabinet for a period of one (1) year;\n(b) For a second offense within a ten (10) year period, be guilty of a Class A\nmisdemeanor and have his or her license suspended by the Transportation\nCabinet for one (1) year, unless at the time of the offense the person was also\noperating or in physical control of a motor vehicle in violation of KRS\n189A.010(1)(a), (b), (c), (d), or (e), in which event the person shall be guilty\nof a Class D felony and hav e his or her license suspended by the\nTransportation Cabinet for a period of two (2) years; and\n(c) For a third or subsequent offense within a ten (10) year period, be guilty of a\nClass D felony and have his or her license suspended by the Transportation\nCabinet for two (2) years, unless at the time of the offense the person was also\noperating or in physical control of a motor vehicle in violation of KRS\n189A.010(1)(a), (b), (c), (d), or (e), in which event the person shall be guilty\nof a Class D felony and  have his or her license suspended by the\nTransportation Cabinet for a period of five (5) years.\n(3) Any person who violates subsection (1) of this section may apply for an ignition\ninterlock license for the remainder of the original period of suspension u nder KRS\n189A.070 and for the entire period of the new suspension if the person is and\nremains otherwise eligible for such license pursuant to KRS 189A.340.\n(4) The ten (10) year period under this section shall be measured in the same manner as\nin KRS 189A.070.","path":["KRS Chapter 189A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49568","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:44Z","sha256":"058b8bfdbd00ae969407e20f65b8863e97935ef4a9d55c30c16f27e70a787bb6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-189a.085","next":"us-ky/krs-189a.100"},"notice":"GroundRules: Original legal text.
