{"data":{"id":"us-ky/krs-189a.104","jurisdiction":"us-ky","citation":"KRS 189A.104","heading":"Alcohol or substance testing subject to refusal or enhancement  of","body":"penalties under KRS  Chapter 189A.\n(1) The only alcohol or substance testing that is subject to refusal or enhancement\nof penalties provided for in this chapter is:\n(a) Breath analysis testing by an instrument installed, tested, and maintained\nby the Commonwealth  for that specific purpose at a police station or\ndetention facility;\n(b) Blood or urine testing at the request of the officer at a police station,\ndetention facility, or medical facility; or\n(c) Combination of tests required in paragraphs (a) or (b) of this subsection.\n(2) The results of any breath analysis by an instrument other than one specified in\nsubsection (1) of this section shall be inadmissible in court.","path":["KRS Chapter 189A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52111","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:44Z","sha256":"134ee888c5ccacd210c178c6ac401302d1aac5746639ab13f0249835c3b94872","source_id":"us-ky","stale":false,"prev":"us-ky/krs-189a.103","next":"us-ky/krs-189a.105"},"notice":"GroundRules: Original legal text.
