{"data":{"id":"us-ky/krs-189a.220","jurisdiction":"us-ky","citation":"KRS 189A.220","heading":"Judicial review of pretrial license suspension for test refusal.","body":"In any judicial review of a pretrial suspension imposed for refusal to take an alcohol\nconcentration or substance test under KRS 189A.200(1)(a), if the court determines, by the\npreponderance of the evidence, that:\n(1) The person was charged and arrested by  a peace officer with violation of KRS\n189A.010(1);\n(2) The officer had reasonable grounds to believe that the person was operating or in\nphysical control of a motor vehicle in violation of KRS 189A.010(1);\n(3) The person was advised of the implied consent law pursuant to KRS 189A.105;\n(4) The peace officer requested the person to take the test or tests pursuant to KRS\n189A.103; and\n(5) The person refused to take a test requested by a peace officer pursuant to KRS\n189A.103;\nthen the court shall continue the  suspension of the person's operator's license or privilege\nto operate a motor vehicle during the pendency of the proceedings, but in no event for a\nperiod longer than the license suspension period applicable to the person under KRS\n189A.070 and 189A.107.","path":["KRS Chapter 189A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49573","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:44Z","sha256":"08fc44200b17daee95f410a13f0a35e1d5341f3c27aa1515cc98f75ab15acb43","source_id":"us-ky","stale":false,"prev":"us-ky/krs-189a.210","next":"us-ky/krs-189a.230"},"notice":"GroundRules: Original legal text.
