{"data":{"id":"us-ky/krs-189a.250","jurisdiction":"us-ky","citation":"KRS 189A.250","heading":"Judicial review of pretrial suspension for causing an accident resulting in","body":"death or serious physical injury to another person.\nIn any judicial review of a pretrial suspension imposed under KRS 189A.200(1)(c), if the\ncourt determines by a preponderance of the evidence that:\n(1) The person was charged and arrested by a peace officer with violation of KRS\n189A.010;\n(2) The officer had reasonable grounds to believe that the person was operating or in\nphysical control of a motor vehicle in violation of KRS 189A.010;\n(3) There is probable cause to believe that the person committed the violation of KRS\n189A.010(1) as charged; and\n(4) There is probable cause to believe that the person was involved in an accident that\nresulted in death or serious phys ical injury as defined in KRS 500.080 to a person\nother than the defendant;\nthen the court shall continue the suspension of the person's operator's license or privilege\nto operate a motor vehicle during the pendency of the proceedings, but in no event for a\nperiod longer than the license suspension period applicable to the person under KRS\n189A.070 and 189A.107.","path":["KRS Chapter 189A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49575","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:44Z","sha256":"42284891926c9c0721a91d7c97819fc5580c6aa491fd6923b6ef2151561fab39","source_id":"us-ky","stale":false,"prev":"us-ky/krs-189a.240","next":"us-ky/krs-189a.300"},"notice":"GroundRules: Original legal text.
