{"data":{"id":"us-ky/krs-189a.345","jurisdiction":"us-ky","citation":"KRS 189A.345","heading":"Prohibition against use of vehicle other than for purpose authorized by","body":"ignition interlock license -- Penalties for unlawful acts relating to ignition\ninterlock licenses and devices.\n(1) (a) No person who is issued an ignition interlock lice nse under KRS 189A.340\nshall operate a motor vehicle or motorcycle without a functioning ignition\ninterlock device or at any time, place, or for any purpose other than authorized\nunder KRS 189A.340.\n(b) Any person who violates paragraph (a) of this subsect ion shall be guilty of a\nClass A misdemeanor, and shall have his or her license suspended by the\nTransportation Cabinet for the initial period of suspension under KRS\n189A.070 for an additional six (6) months.\n(2) (a) No person who is issued an ignition in terlock license under KRS 189A.340\nshall request, permit, or allow another person to:\n1. Start a motor vehicle or motorcycle equipped with an ignition interlock\ndevice; or\n2. Take a subsequent breath alcohol concentration test;\nfor the purpose of providin g an operable motor vehicle or motorcycle for that\nperson subject to the ignition interlock license to drive in violation of KRS\n189A.340.\n(b) Any person who violates paragraph (a) of this subsection shall:\n1. For a first offense, be guilty of a Class B misdemeanor; and\n2. For a second or subsequent offense, be guilty of a Class A misdemeanor.\n(3) (a) No person shall start a motor vehicle or motorcycle equipped with an ignition\ninterlock device for the purpose of providing an operable motor vehicle or\nmotorcycle to a person subject to the prohibition established in KRS\n189A.340.\n(b) Any person who violates paragraph (a) of this subsection shall:\n1. For a first offense, be guilty of a Class B misdemeanor; and\n2. For a second or subsequent offense, be guilty of a Class A misdemeanor.\n(4) (a) No person shall:\n1. Knowingly install a defective ignition interlock device on a motor\nvehicle or motorcycle;\n2. Tamper with an installed ignition interlock device with the int ent of\nrendering it defective; or\n3. Alter, conceal, hide, or attempt to alter, conceal, or hide, the person's\nidentity from the ignition interlock device's camera while providing a\nbreath sample.\n(b) Any person who violates paragraph (a) of this subsection shall:\n1. For a first offense, be guilty of a Class B misdemeanor; and\n2. For a second or subsequent offense, be guilty of a Class A misdemeanor\nand be prohibited from installing ignition interlock devices or directing\nothers in the installation of ignition interlock devices.\n(5) (a) No person shall direct another person to install a defective ignition interlock\ndevice on a motor vehicle or motorcycle when the person giving the direction\nknows that the ignition interlock device is defective.\n(b) Any person who violates paragraph (a) of this subsection shall:\n1. For a first offense, be guilty of a Class B misdemeanor; and\n2. For a second or subsequent offense, be guilty of a Class A misdemeanor\nand be prohibited from directing others in the installation of ignition\ninterlock devices or installing ignition interlock devices.\n(6) (a) No person shall knowingly assist a person who is issued an ignition interlock\nlicense in making a false statement in order to qualify for the employer\nexemption under KRS 189A.340(6).\n(b) Any person who violates paragraph (a) of this subsection, is guilty of a Class\nA misdemeanor and shall have his or her motor vehicle or motorcycle\noperator's license suspended by the Transportation Cabinet for six (6) months.","path":["KRS Chapter 189A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49577","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:44Z","sha256":"a70430c99298b65bc524d9498f915178b16fbbed3b85db7e1a3df94557f0884a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-189a.340","next":"us-ky/krs-189a.350"},"notice":"GroundRules: Original legal text.
