{"data":{"id":"us-ky/krs-189a.410","jurisdiction":"us-ky","citation":"KRS 189A.410","heading":"Hardship license -- Prohibition against issuance when alcohol or","body":"substance test refused.\n(1) At any time during the suspension periods enumerated in:\n(a) KRS 189A.070 for violation of KRS 189A.010(1)(c) or (d); or\n(b) KRS 189A.090 relating to a violation of KRS 189A.010(1)(c) or (d);\nthe court may grant the person hardship driving privileges for the balance of the\nsuspension period imposed by the Transportation Cabinet, if the court finds\nreasonable cause to believe that revocation would hin der the person's ability to\ncontinue his or her employment; continue attending school or an educational\ninstitution; obtain necessary medical care; attend driver improvement, alcohol, or\nsubstance abuse education programs; or attend court -ordered counselin g or other\nprograms.\n(2) Before granting hardship driving privileges, the court shall order the person to:\n(a) Provide the court with proof of motor vehicle insurance;\n(b) If necessary, provide the court with a written, sworn statement from his or her\nemployer, on a form provided by the cabinet, detailing his or her job, hours of\nemployment, and the necessity for the person to use the employer's motor\nvehicle either in his or her work at the direction of the employer during\nworking hours, or in travel to an d from work if the license is sought for\nemployment purposes; and\n(c) If the person is self -employed, to provide the information required in\nparagraph (b) of this subsection together with a sworn statement as to its truth;\n(d) Provide the court with a writ ten, sworn statement from the school or\neducational institution which he attends, of his or her class schedule, courses\nbeing undertaken, and the necessity for the person to use a motor vehicle in\nhis travel to and from school or other educational institut ion if the license is\nsought for educational purposes. Licenses for educational purposes shall not\ninclude participation in sports, social, extracurricular, fraternal, or other\nnoneducational activities;\n(e) Provide the court with a written, sworn statemen t from a physician, or other\nmedical professional licensed but not certified under the laws of Kentucky,\nattesting to the person's normal hours of treatment, and the necessity to use a\nmotor vehicle to travel to and from the treatment if the license is sou ght for\nmedical purposes;\n(f) Provide the court with a written, sworn statement from the director of any\nalcohol or substance abuse education or treatment program as to the hours in\nwhich the person is expected to participate in the program, the nature of the\nprogram, and the necessity for the person to use a motor vehicle to travel to\nand from the program if the license is sought for alcohol or substance abuse\neducation or treatment purposes;\n(g) Provide the court with a copy of any court order relating to  treatment,\nparticipation in driver improvement programs, or other terms and conditions\nordered by the court relating to the person which require him or her to use a\nmotor vehicle in traveling to and from the court -ordered program. The judge\nshall include in the order the necessity for the use of the motor vehicle; and\n(h) Provide to the court any information as may be required by administrative\nregulation of the Transportation Cabinet.\n(3) The court shall not issue a hardship license to a person who has re fused to take an\nalcohol concentration or substance test or tests offered by a law enforcement officer.","path":["KRS Chapter 189A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49582","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:44Z","sha256":"b59ca47371c77c0514b122304c0d8d91339ba2e0e6b038fa39b0a7a6a95d2473","source_id":"us-ky","stale":false,"prev":"us-ky/krs-189a.400","next":"us-ky/krs-189a.420"},"notice":"GroundRules: Original legal text.
